Hello Everybody,

I am a prospective buyer and went to see Tharwani heights 2 BHK flat on 8th Sept. I hit upon this site thru google and I am really worried to see so many problems/issues with the builders. Need some advise. I like the flat. Shd I go ahead on the discussions or shd I look for some other flat.

And I would also want to know if anyone is inttd in selling a flat.

Dear Anil,

Are you saying the work inside the flat is not satisfactory? Quite simply everything inside the flat should be exactly like sample flat. Is this not the case?

Thanks for your inputs. It helps someone like my, living abroad and not able to visit the site in person.

Hello Friends and Neighbors,

I happened to know this site from google few days back and posting this message for all of you.

The real issue to take the possession of the flats are

1) Development charges @ Rs 25/- per sft

2) Maintanenance Charges @ Rs 4/- sft

3) Unreasonable extra charges for stone works in toilets

4) Quality of the works in side the flat

5) Bank Gurantee@ 4%of the aggriment value

The way forward to meet  & discuss the issue jointly with Mr. Tharwani.

Dear Flat Owners of Tharwani Heights

Hi,

I own a flat in Tharwani Heights. I heard that builder has started giving possessions of flat to the owners. Even my flat is also ready for possession. I am told by the co-ordinator of Tharwani Heights that I have to pay @ Rs.4.6 per sq.ft. per month for maintenance for 9 months (till the time society is formed). I want to know from you guys whether anyone paid or agreed to pay this charge.

i would like to know if there is any progress at the builders end.i have been told that some of the tenants have already taken posession.so in this case is he still demanding for the extra amount of the development charges.

do mail in ....as im away and not in india.

is there any more dirty games being played by the builder.

Dear All,

I am also an owner of a flat at Tharwani Heights. The builders have not given any written notice about the extra charge but are demanding payment before giving possession. They are also demanding a Bank Guarantee for the tax amount.

Has anyone made these payments and taken possession?

I just read the comments of you all and can see the problems you are facing. Am an interested buyer in this tower for a 2 BHK on a higher floor. Would you prefer me buying there or wait for a while till all issues are resolved. Are there any available flats for sale? I got to know about a few of them from brokers - but would prefer a direct deal.

As I was going through all the messages ....I realised that I was going through the same problems as you all.

sad part is that im away from India and can t be in touch with mr mohan tharwani like you people....he dose not answer his mails too.

as one our friends mentioned regarding the development charges which he verbally has increased to 25Rs more per sq ft.....was told to me too on the phone, but i have have not done any payments yet please do keep me informed of any other crazy developments if there is from the builders side.

how far is the progress......?

Dear All Members,

Tharwani Broders has ask me to pay the service tax which is equal to 4% of cost of flat. 

With my investigation, some builders are taking this amount from buyers and some or not. e.g, at palm beach reod, Arihant builders has not take this for their 'Mahavir Amruit' building.

As discussed with leagl expert, the court matter is pending and there is a hope to come judgement in favour, as govt has taken stamp duty and registration charges from buyers and builders also passed the tax on buyers only. 

Let me know if any one of you have paid this amount or given the bank gurentee to him for the said amount.

Hi

We received verbal/telephonic demands for extra development charges from Mr. Prashant, who handles finances for Tharwani Bros. But we never received any letter.

We have declined to pay any such charges because the deal was signed off with ceratin rates and the agreement (item no. 20) specifically mentions the amount already paid towards development charges. If the builder incurs extra development cost due to not completing all the work on time and the rising administrative rates, how does that become purchaser's liability? As far as I'm concerned, I don't owe them a single paisa and they still owe me my flat - I've made that clear.

I urge you all not to entertain any such demands. If some people pay, the builder may hold it against people who don't pay and eventually everyone will have to pay.

hi dear members of Tharwani heights,

I'm jagadish (B-503). Invariably, I visit the site every month to check the progress of construction. From October, 2006 to Feb, 2007, the work at the site is not how we all expected. It was very slow and with very less workers. I wonder whether Mr. Tharwanis will be able to  complete the construction work at least by October,2007. But after putting some due pressure on Tharwanis by some of our co-members, the work gain good momentum. Recently I visited the site on 29th April, 2007 and found that the work is carried out at a very good pace. Lift is being assembled, tile work at main lobby is at the verge of completion, external paint work is under control, swimming pool and club house are almost ready.  I have been made to understand by the supervisor at the site that the internal painting work is completed upto sixth floor starting from top. Though the construction work is considerably under control, I have my own apprehension about getting possession letters  by 30th of May, 2007 from the Tharwanis.

Interesting things to be noted:  Recently, Tharwani brothers bought new high end sedan. The new office at Sector-17, Vashi bought by Tharwanis is well and expensively furnished with all type of electronic gadgets.  It looks stunning and mind boggling.

Mr Tharwani, we are not jealous of your progress and prosperity at our cost.  "WE JUST WANT OUR FLAT, OBVIOUSLY BEFORE 30TH OF MAY,2007".

Hi,

I am Prasanta Nath, planning to buy a 2bhk flat in Tharwani Heights in Palm Beach Road. I visited the site on April 28th and saw the model flat also. I talked to the builder who says the flats are ready and will be given possession by May end. Presently he is quoting Rs.5,250 but negotiations are going on. 

I would appreciate your advice and comment regarding the building,  amenities and  the offer.

I happened to know this site from google today and posting this message for all of you. I had personnaly discussed this with Tharwani brod and promised to start the furniture work after 10th May 2007. Accordingly i have selected the agency who would start their work by next monday and from 11th May 2007 in my flat. With greate difficulties i have taken admission of my child in nearby school in sanpada. On top of that I have sold my existing flat to reduce the financial burdern with rizing interest from bank. I have sold my existing flat before i take the token amount from Tharwani brod. who had told me during Feb 07 that they would complete the constrution work and handover the flat to me during 1st week of May 2007. On their verbal promise i have taken the token and now thought i have trusted worng people. Now i am getting more and more tenced because yesterday i could see that lot of work is still pending.

On 25th 7 of us met at the building site discussed about the wayforward and decided to meet the Tharwani brothers, We had a long meeting with Mr. Mohan Tharwani, according to him there is a delay of couple of months from his side. He promissed to delever the keys with occupation certificate latest by 31st May 2007, According to him he has increased the club size from 500 Sq. feet to 2000 Sq, feet, changed the exterior painting from acrilic to ruff & tuff paint which has a life of ten years. One passenger lift in each wing will be ready by 15th April. He is not in a position to hand over the keys for furnishing work before end May due to OC related issues.

We have raised the requirement of Internet and DTH facility, which he agreed

Did you folks meet at the building site on 25 Feb as planned? I would have loved to be present but people like me, staying overseas, don't really get a chance to meet face-to-face.

So, any updates? Please post the information online whenever you can. It really helps folks like me to get a true picture - I have almost had enough of this bluff from the builder and his staff . Thank you for your time.

I have booked a 3 BHK flat in Tharwani Heights, as you all waiting, I am also waiting for the possession which was Dec 06 as per the agreement and later on 31st March 07 as per Tharwani brothers when met them a month back. We are planning to meet the fellow/ future neighbours on 25th Feb evening at 5:00 PM at the building site. Please make it possible if you are in Mumbai

I do agree with some of members that builder is telling different things to different people. Recently he said completion date is May 07.

Have you all registered you flats. If so does the AGREEMENT talk of a completion date. I think
it is mandatory that the Builder/developer put completion date in the Agreement. That is th only way to
put pressure on him. Also there must be a penalty caluse in case th project gets delayed. WHich is what Good reputed Builders do. I Suggest that we all meet at the site on a Saturday/Sunday  and discuss threadbare. Please inform all owners to particpate.

Hello fellow members of Tharwani Heights at Sanpada,

I had been to the site on 13th Jan, 2007 to see the progress on the building. I met Dinesh who is supervising the construction. According to him building will be completed by March end. After that they will apply for NOC from authorities and in Dinesh's words that may take 15 days to months.

I am not very sure of that (31st March, 2007) as lots of work is yet to be completed. In fact, another member (Flat no. 503-B) Mr. Jagdish  was also there. He told Dinesh that he has got admission for his child with great difficulty in DPS School and would like to have the house at the earliest. Dinesh's reply was that Tharwani himself had got admission for his childern in the same school for the next academic year. God knows how true that is!

I told Dinesh that the no. of people working on this project is very minimal. I saw a few painters working on the front side of the building. There is progress on the community centre and temple. But work in the main building is being done at a snails pace, The rate has beemn jacked up to Rs. 5250/sq. ft.

I think we have to pressurise Mohan Tharwani to push things faster. So consultation with each other is very very important.

Let more of us get to know each other.

I sincerely urge you all to spread the word among other fellow buyers you may know and get them to join this blog. I think it is important to support each other with as much information as we can because the builder doesn't seem to keep his promises.

I happened to stumble across this website when I, just out of the blue, google'd this development. May be this act of mine was out of frustration which is  now becoming unbearable of not seeing any possibility of completion of Tharwani Heights in the near future. But then I saw few messages posted on this portal by some of my potential neighbours or building society mates (if that is ever going to happen) and thought of pen'ing few lines myself.  

Well as some of you have already raised, the completion of this project looks like a distant dream something as unreal as Indian cricket team ever winning an Overseas test series And  Mohan Tharwani's promises as empty as our politician's agenda list at the onset of every election campaign. 

I have been out of the country since the past six months, so haven’t had an opportunity to chase Tharwani bros to get from them another Indian Metrological kind of prediction about the completion of what they call a Dream Home , something which is already becoming a nightmare. So a humble request from me to all my future neighbors to fill me in on any recent ‘development’ (if anything like this is happening) since the past six months on this property.

My father recently saw builder Mohan Tharwani who assured of giving possessions before 31 March 2007. I have two questions for you:

1) Tharwani has asked us for additional money by saying that he now wants to increase Rs. 25 per sq. ft as development charges - this is on top of Rs. 125 per sq.ft. he has already charged as development charges at the time of registration. He also claimed that he has charged this extra money to all buyers and some people have already paid - this is to be paid before 20 Jan 2007. Is this true? Have any of you paid this already? or is the builder playing cheat games before possessions?

2) The builder claims that 95% of the work is already complete but recent visits to the site suggest there is a lot of work pending, especially behind the building - all the parking spaces, clubhouse etc. What are our options if the builder actually doesn't complete all the work and starts giving possessions?

Hoping to see some responses. I'm really concerned about these things at this point.
