Thank you for your e-mail and sorry for not replying you before but I have found your e-mail in the spam. Regarding your queries:
1. According with our conversation with the developer and the experience that we had in Puerto Marina there will not be any caps to your penalties. They will run from the 1st october 2007 until the date the license is issue.
2. Regarding the cancellation the notary has informed us that in case the developer has not complete before the end of November you will be able to request the refund. Please let me know if you want to take this option before for check other options if is required.

Progress report - I was in Sania between 20th & 27th Oct. Having been round the development, the good news is that progress is being made, with second line looking complete including entry phones added. The only work that seems to be left to do is shutters on block m & n to be added and the garages below the blocks to finshed off.
The swimming pools are finished and also landscaping around pools looks finished.
In terms of frontline the building has progressed and they have painted the blocks closed to the proposed hotels and windows have been fitted. The two centre blocks are only ones not finished, but half way there, so hopefully they will be completed in the near future.
Wall and steps to the beach have been completed.
Also they have built a bigger drainage channel by the side of block A leading from the road to the beach, which hopefully mean the water course which runs through the development to the sea will mean the rain water will be diverted.
There were builders on site, even though it was ramadan and there is barrier at entrance to the barrier, so access is restricted, which suggest that flats have been fitted out.
In terms of area around Tamuda Bay, this is looking good. The pavement from Mdiq to Softel has been completed and there have been replanting of palm trees. Also they ahve built a couple of car parks and have put up signs which show how public can access the beach. Kabila Smir development is progressing at a rate of knots and some of the buildings looked virtually complete. Around Marina Bay, the two partially (derlict building) have been knocked down. The highway from Tetouan to Fnideq is completed and open.
Around Fnideq, they have further tidied up the seafront and made a small park/walkway across from Alkudia Smir development.
Sania and Tamuda Bay are both looking good, and the light seems getting closer to the end tunnel.
Not so good news - During my stay in Sania there were couple of times when there was heavy rain, and the day after I left, both Fnideq and Ceuta suffered bad flooding (if you want to see footage look on You Tube), I suspect that there must ahve been some flooding in the Sania area but I have not been able to get news on this. All of this is likely to have impacted progress being made by the builders at Sania. In regards to the potentail completion date, my guess is that it unlikely to be before Decemeber at the earliest. I was advised that the developer is in Saudia Arabia from Ramadan, and that in terms of getting habitation certification this means it will be further delayed. Also my the developers and Governor of Tetouan area have a difference on view, as such this impacting on the issuing of the habitation license. The hotel foundation are in but not much else, and the foundations were covered in water.
I have also found a route from Tagiers airport to Sania which seems easier and quicker to Sania by car, apoalogies if you are aware of it. From airport road, when you get the to themain road, take a right i.e. away from centre of Tangiers and towards to Asilah. this road will lead you to the motorway (toll raod), when to get this road, follow the signs for Tangiers Med Port. The motorway is very quiet and fast, and it takes you as far as Tangiers Med port (NB before, you get to Tangiers Med Port there are signs for Tetouan, if you follow these signs then it will take you on the usual road to Tetouan) - but if you ignore the signs and follow those tangiers med port, then you will have more of your route on the motorway. At tangiers med port, the motorway ends, and then it becomes a dual carriageway road through the mountains to Fnideq, which is about 10 to 12 kms away.

just thourght I would offer my apartment in Marina Beach to anyone going over for an inspection etc. It is listed here on this website obviously mates rates will apply. it sleeps 6-8 and walking distance to Marina Smir. I have some local contacts for airport pickups and trips to Chefchaun Tetouan etc.
I can also help with quiries w.r.t. banks and mortgages as I have been through this process.

I have just returned from Tamuda bay having supervised the completion of my furniture installation at Marina Beach. I am happy to report that all the furniture purchased via *** has now been delivered and is being installed by a number of English guys, the furniture is of good quality.
I dropped in at Sania Plage as promised and took quite a few pictures, I will post these on the photo section. if any one wants to ask any specific questions please feel free. there was little activity on site due to the summer season.
I have also completed a local mortgage with BMCI bank in Tetuan, unfortunately having a mortgage adds time to the legal process of obtaing your title deeds. the process getting licences etc seems to take a good few months after competion. Our purchase is complete and we are very pleased with it. However, we have been advised to organise a Moroccan will with regards to our property. Has anyone done this? Or could throw some advice on how to proceed? Any advices gratefully received!!

According to our solicitor in Morocco, the developers have "applied for the habitation license to be in place at the end of June and if there is any changes before that time we will be informing you direclty" - but I wouldn't put any bets on this date. I would like to think that we will have completed purchase of our apt in phase 1 by December, but, if past experience is anything to go by, a lot (or a little!) can happen in 6 months.

I have purchased a front line apartment and would like to know whether phase 1 is ready yet? If not how far behind are they and is this also the case for the front line as completion expected Dec 2008 - or is this highly unlikely?

Not sure if you guys are aware but when I was there in March 08 - I was told buy the MRI driver that ALL construction work along the cost road has to stop between June and September. this is to clean up the area and prepare for the summer season and when the King arrives in July / August. the reason that the road side of Sania Plage was completed first is that this is what the king sees from the road. Sadly the front line has taken a back seat. this is the reverse of what is logical when building a project as it is a lot easier to build your way from the front out. It is unlikely that this development will be given a habitation licence until all the facilities have been completed. I am going out in the next few weeks and will find out for you what the construction status is - however I suspect everything will be on hold.
the good news is the road from Tangier is now complete and journey time will be greatly reduced. I undrstand this was on the kings wish list for his summer holiday.
its a shame the king did not buy furniture for Marina beach or an apartment in Sania Plage as bith would be complete by now! | ronnyb |

everyone, good blogging from Sania Plage, I am an investor in Marina Beach - sadly they took our message boad off line after too many derogatry comments about 'Yuo know who'.
Anyway my message is this: I purchased a furniture pack in June 2007 (yes 12 months ago) and I have not yet been given an installation date. they have had a number of problems with the suplier and trying to sort them out. I am renting this summer (not via you know who as the system does not work in the Moroccan market by the way) and so I have paid for furniture from another local company (3 weeks and they have started - its a miracle) I have cancelled my order with *** and asked for a refund - they have obviously refused saying they will deliver this eventually. Obviously I am not the only one and we are all potentially loosing seroius rental income. I will get my money back eventually but I strongly recommend avoiding the *** route or check the terms and conditions which can only be found on the website www.lifetimeaftersales/furniture/index
