Hello Everyone, My wife and I are considering making the down payment to purchase lot 39. I would be interested to know if in fact all the other lots listed as sold, actually have owners. Please respond, if you are so inclined with the lot number you own and how secure you feel about the future of your investment. Everyone - be warned that we got a call too that the lawsuit was settled and to proceed with our purchase of our lot; HOWEVER, we made a surprise unnanounced visit the week of April 11, 2008 and the development was in complete disrepair, the only houses were that of John Usher and the model home.  The model home landscaping was overgrown and unkept.  The people in the "office" could barely speak any English.   The roads are in worse condition than when we visited in 2007.  There was no construction equipment or progress.    It was pretty disenheartening - especially since there was so much construction going on during our visit in January 2007 and it looks like absolutely nothing has happened since.  They were also supposed to complete the road to our parcel and it is in effect removed or washed out.  As of our last contact with them a few weeks ago, they said they do not have a new developer and do not have the money to reimburse our deposit per the request that was on file for over a year so they are keeping our deposit on record toward our purchase.    We hope this development proceeds and understand that the lawsuit delayed their progress; however, it is scary that they still cannot name a new developer or verify they have the funds to proceed since amenities and overall resort were the selling points to the parcels which are significantly more expensive than non-resort parcels in the region.      If someone has pictures showing any progress since our visit in April (real progress not just road construction), we'd love to see them as I'm sure everyone else would.

Hello Everyone.  We are the owners of lots 64 and 52 and we are very proud to say that good news has come to us.  All of us.  Hang in there everyone.  John Usher has stated that the settlement is complete.  I am ready!  Stay positive and patient...It will all pay off down the road.  Cant wait to set foot back on the development when the activity is lauched.

I've spoken to Robb Evans (Brick Kane) last week and he said they are very close to an agreement to give back all ownership and rights to SRWR. Once that is done it will be interesting to see what is done.

I received 2 e-mails from John Usher (Both on the 31st December).

Firstly comfirming that SRWR & Robb Evans have come to a mutualy acceptable agreement & secondly that the legal process is being finalized.

I am curently waiting for a 'settlement figure' for my two lots.

No sorry to say the whole project has been put on hold. there is a riff between two parties as to who owns what, seems the developer and his partner used money that may not have been theirs......

Those of us who have either an interest in, or may have already bought a lot in Sanctuary Bay, need to stay in touch. In case you may not have noticed, the support unit for the other location/forum for info on Sanctuary Bay Estates has elected to go off the air.  But the Owners Group(SBOG), concerned about the development and the flow of info to all, have created a new site, transfered most of the info from the old to the new location, and it is up and running.  Just because people do not want to join your group doesnt mean they are not active in trying to keep the  development going and protecting their investments.

I ,you twit ,would rather talk and talk and talk some more  then use lawyers. The probelm is none of you are confident in your own abililty to talk with the recievers so you hide behind a legal shark which in my opinion is the worst thing you can do.

Wow, this is the most activity Eye has seen in awhile! I know the other forum isnt super active all the time, but I cant imagine sitting on this one talking to myself for a month.

FYI - I just added a hurricane section to the forum so we can all post about the hurricanes. Little test run to see how popular it is.

Ladies and Gentleman---and you,too, Tiki2!

     I've been reading the posts on this forum for some time, and I find some of them almost unbelievable!!!  Yes, all of us property owners are probably a little skeptical/scared of the current situation and are looking for the latest and most current information in the on-going Rob Evans fiasco. I suspect ( and hope) we all want to protect our investments, we'd all like to see Sanctuary Bay continue to completion-in a timely manner, and we all want to know the latest of what's going on.

     Well, I'm here to tell you that there is considerable activity, and quite alot going on.  And a lot of that activity is by your fellow lot owners--- trying to be proactive, and not just camping out on a forum complaining!  The most current general info available is on the lot-owners forum.  The offer has been made,several times, to join.  In addition, the offer has also been extended to all, several times,  to join with other lot owners to legally protect what we've all bought into.  Some of us have stepped up to that plate, and are actively trying to make a difference.  And those that have do have access to all the latest status and activities, and can make input to that ongoing process.  But nothing comes free--there is a small cost involved, to try to protect your lot and your larger investment. And only those who have stepped up will likely enjoy the full benefit from that effort. Maybe its time you put your money where your mouth is. Maybe it's time to stand up and be counted; be pro-active!

There is no public update because aside from what we are accomplishing with our attorney as a 28 owner group, there isnt much happening. SRWR and RE are still bickering back and forth over rights and money, SRWR is still broke, and development has halted.

The other stuff, ie: what our group is accomplishing, will not be posted here or on the other board because they are not secure enough to protect that information from parties that could undermine our efforts. Im sure you understand.

It seems that if anyone is still making payments you might need an attorney in both Belize & the US, Robb Evans might become a thorn in everyones side, to be fair I may be speaking prematurely (about Robb Evans) just stay on top of things. I have been informed that SRWR currently has ability to transfer title & is currently doing just that with certain lot owners still waiting for legal confirmation though, it shouldn't be long. I have heard nothing about the river lots though I was told directly from one of Robb's associates over the phone that they have control of those lots. Also sorry if I scared anyone in my last posting I was just frustated.logan
I wouldn't throw good $ after bad, better make sure. If this is a rip off it's probably already too late. I think multiple demands of the exact same thing from everyone would be the most effective. logan
I'm not positive but I think everyone should demand proof of ability to transfer title either from SRWR or Robb Evans very soon or else hurry to your attorneys. If anyone has any real info please post it.logan

Hello All,

My wife and I received statements from Robb Evans.  They retrieved the data from Starfish.  Interestingly, they have all of our payment history!  Anyway, we are still not convinced that they are able to award any title and so...we wait to see what happens next.  Waiting to hear from John Usher.  He is doing good things and I know his reputation is good.  He is honest and hard working and I belive that he believes.  If anyone has received titles for their land over the past few months, it might be good information to post.  We expect to receive the title for one of our lots within the next couple of months...will keep you posted.  We are also getting ready to build our house but still waiting for Yannec to finish with the plans.  He put our driveway in a couple of months ago.  We are already in and believe in this place.  We are going all the way.  It will work out...its just a matter of time...

i just recieved an email from SRWR stating that the RIVER LOTS are legally owned by Robb Evans and payments should be made to them, they are the title holders and will be the ones issuing the titles for those river lots.

My wife and I own (outright) Lot 82 (Lot 5 on the plat). We have been following the proceeding over SB and have watched the correspondence between owners on this and the Eyeonworldwide forums. I would like to contribute my thoughts for consideration and possible discussion with John Usher during the planned phone call.

First, I am not an attorney although I have worked extensively in litigation for several years. I recently re-reviewed the documents related to the Robb Evans recievership actions available on their website. Several documents are relevant to the status of Robb Evans and the position taken by SRWR, as described in John Usher's letter of April 24th.
First, SRWR was created as a non profit Belizean company and as such has a governing board and a membership. Its assets (mostly the 11,000+ acres) were legally purchased from funds lent directly or indirectly to SRWR by Pukke. As of Novenber 2005 these loans amounted to, what I infer to be BZ$, some $6.7m. The loans are unsecured, carry 1.1% annual interest and are to be repaid at the discretion of the SRWR's board. There appears to be no documented shedule for repayment of the loan. It would appear that this represents the only interest Robb Evans might hold in SRWR. They are unlikely to be able to change the inferred terms of the loan and SRWR could simply compound the interest, ad infinitum.

With the exception of the River Lots and other real property owned by Dolphin/Starfish, all other lands are owned by SRWR or lot owners (such as ourselves) through clear title.

Based upon my understanding of the legal system applied in Belize, the ownership of property remains that of the original owner until the purchase is complete, through the discharge of the legal and financial terms of the purchase agreement. As the ownership of lots covered by purchase agreements is held by SRWR until such time, paying Robb Evans for an asset they dont own would appear to be illogical at this time as it is not clear that they could instruct SRWR to transfer ownership to the new owner upon completion of the terms of the purchase agreement.

In the board minutes for SRWR it appears that the precident is set for the board to decide who and under what terms the assignment of rights to a developer can be made. Having retained Rodwell Williams as our attorney during the purchase of the lot and as an agent for property tax payment etc., I doubt he would have advised SRWR to act as it has, regarding cancellation of real or inferred development rights that Dolphin/Starfish/Evans may have had, if the legal ability ot do so did not exist.
Robb Evans rights appear to extend only to the rights and assets that Pukke (either directly or indirectly) has (or had). The reciever's rights do not extend or have authority over Belizean companies or assets not owned or controlled by Pukke, as appears to be the case re SRWR.
The assets of SRWR were not included in the contempt ruling as it appears that the assets are not owned by or controlled by Pukke. Only the "contract rights, development rights, ownership rights and property rights" held through Dolphin/Starfish" are listed in the Court Order.
Robb Evans letter of April 25, 2007, if anything, is a fine example of legal inuendo. Use of the term "legally improper" (rather than illegal)suggests that they dont like it but can't do anything about it. As the US District Court has no jurisdiction over the actions of a Belizean company it is difficult to see how the "letter" (note: not action) from SRWR exactly affects "the District Court's .... orders and invades the rights of the Reciever...". The inclusion of " the rights... in SRWR as determined by the courts.." also appears to be factually inacurate and legally improper as the order only deals with the rights (if any) held by Dolphin/Starfish. Again, I am not an attorney but the whole letter appears to be mostly smoke and mirrors, if cleverly written.

Agreed, I posted some time ago that the estimate (from John Usher) to just bring water and electric to all of the lots was $1.5 to $2 million and to complete the development as originally presented would be $18 to $20 million.  Guaranteed "Smokin Bob" Evans has not the resources or intention to complete this project.  Stick that in your pipe and smoke it Tiki2, on second thought a bong might be more cost effective (which we all need at this point).

again if hes  looking out for the lot owners and not his clients (and himself) meaning Robb Evans llc. then why not let all the money go down to the development which he says they now own. This way the lot owners are comfortable and the development continues. I feel if he gets the mony it will never go to finishing the project.

again, we can only go by what we are told, but Kane said that when Pukke/baker bought the land, they transfered ownership of the river lot section to Dolphin Development(which was still basically them) and the remainder went to SRWR(also basically them). And that the river lot section is the first section they relinqushed control off. i am assuming thats why i received the letter from usher today.

i questioned Kane that my contract was with SRWR, not dolphin, he said that agreements will have to get re-written indicating the correct info as all ownership entities are  intermingled. I then asked for an invoice from Evans which he said he couldnt get out quickly because they still dont have all info on the site which is one of the reasons for their visit next week, and some ackowledgment by Evans of their intention to honor legal contracts, and he said that can happen.

I will absolutley post that entire letter, assuming i get it.

 I remember someone telling me when I was in Belize  that a few of the river lots were owned by Sanctury bay Ltd which I think was  owned  by Peter.

I too wish I knew what was the truth,But I have to go by what I see and base it on the fact that I have a contract with SRWR. That is why I will make my payment to SRWR.

Who owns it will be sorted out in a Belizean court Im sure,but I will not be wrong by sending my money to the vendor I have a contract with  instead of the Broker, which I thought odd from the start.

i'm not that quick of a typist and thats the meat of the letter and it is just my opinion that  A letter, not THE letter ( i am sorry for any confusion) seems reasonable. Further, i only base my reasoning on the fact that if  Evans wound up with the river lots, why woudnt they also wind up with the rest of the lots.

like you i am only expressing my opinion. thats also why i said I (and only myself), would not make payments until a letter was received.

as it stands right now, only the river lot owners were told to pay Evans by John Usher acting chairman of SRWR.

ok here's the latest;

i received a letter John Usher addressed to all river lot owners that plainly states that Robb Evans is the legal owner of the land that comprises the river lots and that all future payments and contact has to be to Robb Evans.

So at least for the river lot owners there is no more question as to who to send payment to and who will give title.

It would then make sense that the letter to the remaining lot owners indicating Robb Evans is in total control is only a matter of time.However until that letter comes i personally still would not make payments to anyone. 

I spoke to Brick Kane and hopefully will be receiving some type of documentation that Robb Evans intends to honor all legal contracts and missed/late payments will not be held against us.

Tiki(2) with all due respect, you need to take it easy. We are all in the same position and to say we are giving the upper hand to anyone by any of our actions is not fair and just not true. Don't think confusion = stupidity, because thats what some of your comments have sounded like.
