MUMBAI: The Supreme Court has referred the Maharashtra private forest land case to the central empowered committee it has set up.

"The case came up for hearing before the apex court on August 29. Now, the case has been referred to the empowered committee. After the committee takes a decision, it will come up for hearing before the SC after six weeks,'' a forest department official said on Monday.

The Vilasrao Deshmukh government has already submitted a comprehensive affidavit before the SC, stating that it was keen to help the innocent flat owners in the metropolis. The case pertains to the completed and under-construction flats on private forest lands. Following a complaint by the Bombay Environmental Action Group, the state government had undertaken a survey of private forest lands and after confirmation, specific entries were made in the records of the revenue and forest departments.

Since it was confirmed that these were all private forest lands, the BMC had issued stop-work notices to all constructions. A section of builders had then approached the high court, which held that all constructions on the private forest lands were illegal.

Subsequently, the builders had approached the SC against the high court order. In between, Deshmukh had held a series of meetings with the representatives of aggrieved flat owners. The flat owners contended that when they bought the flats, they were unaware of the status of the land.

Supreme Court has extended status quo order in Mumbai 'private forest' issue

New Delhi, Aug 31 (PTI) The Supreme Court today extended its status quo order that wi ll prevent the the Maharashtra government from taking any action against constructions on 'private forest land' that were dubbed by the Bombay High Court as illegal.
The Bombay High Court on March 23 this year had held that all constructions on private forest lands across the state were illegal and action should be taken as per the provisions of the Indian Forest Act and Forest Conservation Act.

The impugned judgement affects vast tracts of land aggregating to approximately 9193 acres situated within the municipal limits of Greater Mumbai which have been developed over the past 50 years into residential, industrial and commercial complexes.

Hundreds of residents and leading builders in Mumbai's eastern and western suburbs in the Bhandup-Mulund-Thane and Borivli-Kandivli belts are adversely affected by the High Court order.

A bench headed by Chief Justice K G Balakrishanan extended its status quo order passed on May 5 and asked various leading developers -- Godrej & Boyce, Nanabhai Jeejeebhoy, Atithi Builders, Normal Lifestyle and Nirmal Developers -- not to create any third part rights in respect of flats built by then in the area.

It, however, referred the Maharashtra government application seeking protection for innocent people to the Central Empowered Committee, which is assisting the court in the forest matters.

The state government has stepped in to seek relief for the innocent flat owners on private forest land as they were unaware of the status of the land.

The Maharashtra government while seeking a direction in the larger interest of public said that it intended to resolve the problems of lakhs of people by allowing non-forestry activity on such private forests in the state. PTI

Update on Construction:- Is totally stopped as of now.

Update on Forest Verdict:- Hearing on 27th Aug 2008.

I am going to Mumbai on 3rd week of Aug if I can will get some photos of it.

Meanwhile anyone can tell what is the latest rate/psqft in Runwal Infinity.

Relief for Forest Land Flat Owners

People owning flats on so called forest land can heave a sigh of relief.

According to reports appearing in most of the newspapers today, Chief Minister Vilasrao Deshmukh has assured the flat owners that the state government will be filing an affidavit in the Supreme Court accepting its mistake of not notifying the forest lands acquired by it and delaying the mutation of the land records.

The Chief Minister has assured that flat owners / builders will have to pay a fine of .70 to 1.40 rupees per square feet of their flat area as penalty to regularize the flats. Therefore, if you have a flat measuring 1000 square foot you will have to pay a minimum penalty of 700 and a maximum of 1400 rupees to regularize your flats.

This money will be used for creating forests at an alternate location.

Also other plots that were acquired for forest purposes will be allowed to be constructed upon as relief to those plot owners who did not benefit from the errors of the government.

Mumbaikars can travel to these forests to breathe fresh air!

I have booked flat in B2, Sanjay is now telling me that registration is kept ON HOLD now as forest land issue is still going on. I don't know whats going on, anybody having any clue?

I just joined in. I am keen to know the current status of registration of B - 1 flats. I am told by Runwals that it is still on hold. However some messages here are saying that registration is going on ( or was going on in Jan 2008).

Hi All,

Hope the forest land issue is sorted out at the earliest....I am very optimistic that the SC will rule in our favour and also the forest minister who initiated the case has given a statement that its is the governments responsibility to protect the structures ( then why a case was registered in the first place )

Seems Runwal Infinity are to charge Rs. 350, 000 instead of Rs.250,000  for car park-podium type. Is it true ?

I went to mumbai this week. I found that Runwal Infinity is going to hike the rate by 7500/sqft.

Hi,

I have been to the site in end Dec. The progress is very good. 3 buildings are up and work is going on 24 hours. Interiors will start soon.

The forest land issue will also come up to close in 2 -3 months and the result is expected to be positive.

Registration of flats is ongoing actively. During the time , I was there for say 30 minutes, there were 3-4 interested buyers.

as it is developing , the site looks very good especially the walkway in to the buildings and the location site of Runwal Infinity.

Runwal has started registration of all its flats at Runwal Infinity mulund. Price has also gone to 7000/sqft. Work Progress is going nice too.

what I understand is this :

Now upto 18th floor the slab has be laid. Infact now the work is going on for all the 5 buildings. Previously only 3 buildings were under construction, but now the construction for the remaining 2 buildings has started.  the work is going as per schedule. Also the wooden frames in all the windows in one of the building has been fitted upto 15 floor. So the progress is fairly well.

the last information that I have is that construction is ongoing at Runwal pretty smoothly.they are also confident that the court verdict would be in their favour as lots of development projects are affected.

I have booked 2BHK flat in Runwal Infinity on Mar 2007. Till date(July 2007) they have not gone for registration due to court order. So please can anyone guide me on status of registration and other details related to forest land which will affect runwal infinity.

I think we should not worry much abt the the current court case.

First of all the plot beloged to a company which was there for decades .

also behind our plot there are many private bungalows in there....

Secondly if we can all form a group on orkut or any other site and be in touch it will be better for us in taking any further decision..

I just heard that deforestation case is a done deal and seems to be in builders favour it seems to have come in TimesofIndia few days back during week of 14may2007 to 22 may 2007.. i am trying to search on the web for this info.

Hi,

I have just booked  a 3 BHK on A1 @ 5025 psf base plus some floor rise...

They have got a interim order from the court(the matter was sub judice in their favour) the final order is pending and probably will not happen for another 3 years or so going by Indian Court Timelines

I have seen the court order copy and have conferred with my lawyer ...There is some element of risk but I think it shall pass as long as the bldg is constructed in Time...

Also I have talked with the Chief Forest Officer between Thane and Mulund Region...He has said LBS marg is generally not a problem...

Also with 500 families (am assuming well to do ones), matter can be strongly ruled in our favour....

A1 has been completely booked(I had booked the last but 1 flat remaining and have seen the names of all the people)....

B1 construction seems to go on in good pace...

They are witholding booking for A2 and are waiting for the Prices to rise which I think will take a while considering the already inflated prices....

as I hear from them , they have approved plans with a MOU between BMC and Runwal. They promise to deliver by Dec 2008.

I have checked with their construction and marketing team and they are not clear as to who has created this rumour on non approval of their project.

I am told that construction is on at 12th slab in B1.

They mention that they have not recieved any stop work letter from forest dept/any concern dept.

Runwal has no approved floor plans and No Commencement certificate for 7th floor onwards for any of the buildings for Infinity. Inspite of that Runwal is constructing the higher floors (at a snail's pace though), Besides that issue,  there is the Forest land issue which is sub-judice in the supreme court. The booking rate has been increased to Rs. 4800/- psf now.amjadhav
Construction has stopped...Forest Land Problem will make this construction next to impossible. Even if the construction is finished, the chances of getting a permit to stay on the premises seems very difficult. Almost all the friends who buy/sell properties for business have told me to not get into buying these constructions....as it is VERY HIGH RISK! So these constructions are a natural NO NO...My opinion after 1 month research living in Mulund was this. drpmulay
They have increased the price to 4750 / sq ft Jan 1 onwards since they have the approval and works in progress
