Hello to all buying or have brought at peace valley.. My name is Debbie and i have purchase an apartment and shops.. Over the pass week i have been told by the developer and lorraine not to give money to Nelson and Denise at the Villa Company.. not to trust them etc etc etc..
I am wondering if anyone who has purchase has had any problems with them..I am in no doubt that after three years with dealing with them they are the most trusted and loyal people i have ever come across..
Actually for me it has been the most stressful situation i have come across not knowing who to believe.. The developer mr Kumar or Lorraine saying to trust her..
Would anyone please give me your opinion on whether you have had problems with the developer or the agents.. I am still waiting for an email from Mr kumar to confirm in writing this but as you probably guess i will be waiting for a long time..

Do you fancy helping those less fortunate than you and signing the Number 10 Downing Street petition aimed at bringing the attention of the UK politicians onto those of us that are not so fortunate as to have a developer who will do everything that has been promised.
I guess most of you will be posting on your 'Peace Valley only' site by now but if anyone out there cares please look down the postings and sign up to the petition. We are nearly there with the required numbers and one day it could be you who needs the help.
Check out the local Goan press (Herald, Goan Voice etc.) to see what is happening to the beaches and tourists.

Many thanks for your positive feedback so far. Judging by the posts and user registrations it seems that the new forum is near live already! Maybe we can all try using it for a week and if everyone is happy and comfortable with the new format and overall website performance, then we could switch to using the new forum for new discussions/topics?

It would be even better if the builders agreed to use the update section...especially to upload progress photos, but before anyone else says it......I won't hold my breath!

We paid all of our money through Nelson and Denise so we didn't have any problems, but we did have to send our costings for the fixtures and fittings as they did not agree. To be fair though, we had cancelled some things which added to the confusion!
Like Tracey, we did manage to get them sorted out but it did take a little while via e-mail so think a quick call may be a better idea!

Over the weekend I have done considerable research into this matter and Westley is correct in what he says. The registries have been closed to registrations of property to FN's since September 2006 and sub registrars have been instructed NOT to register properties. Check Danika Residency - D97 which true is another Micon development, but has very relevant information concerning this issue. Micon are not giving deeds to FNs because they - rightly or wrongly - believe they will be breaking the law. However this is not an issue that only affects Micon properties, it is affecting others as well. There are people out there who have purchased legitimately in the 80's who have been threatened that their properties will be confiscated and have been thrown ourt of the country!! There has also been a great fuss made in the local Goan press regarding 'paper' companies - those set up to purchase small properties only. The number of businesses opened and owned - part of fully - by FN's is now in the spotlight.
It is true that most have at lest 4/5 years left on their lease and hopefully things may settle down in that time. Do read the Goa - Byer Beware thread on BritisExpats site. It has been running for over a year and as you British say, there is no smoke without fire! | ToldUSo |

If not are Salv and I the only ones concerned about wether we are all going to actually ever own our properties, or is everyone happy to leave them in the Kumars names and just have the contract.
Please can someone in the same situation as us tell us what they are doing regarding this matter.

The main issues are quite rightly put, however some of the issues will affect us all. As you know I am to challenge a number of legal issues that I also addressed with a number of MP’s on Friday. I have followed all FEMA and RBI conditions so if they will not prepare my deeds then I will take the appropriate action. I do not want to make any money or take funds of out the country. My family have a long historical involvement with the country and I still love the place. I am even trying to get some of our students out there on third year placements in one of the orphanages. I won’t go on here or think it appropriate to, but you know the level of people I know both here and in India, I have never had to use those connections, but I sure am now. I know Westley and am aware of some of the problems he has been having, so I will try and clarify for you - I'm sure he'll put me right if I get it wrong!
He has purchased a two bedroomed apartment in Micon Arcade in Cavelossim. The purchasers had contracts to say that they were purchasing a freehold property. The Limited Company was all set up properly but when they came to complete the builder (Micon) would only give the majority of them a five year lease!
I think that Westley is trying to point out to the other Micon purchasers that although they may have the freehold they could still have long terms issues which will affect all of them, and it is in all of their own interests to take these issues forward collectively. I know that Westley has been challenging the builder himself and may be looking for a bit of support and back up from some of the other owners.
There have been many problems with this builder over completion - too numerous for me to mention on this board, but if you want to see where Westley is coming from and some the the problems he's trying to address, add the Micon Arcade M419 development to the message boards.
I think the FN stands for Foreign Nationals, which is the category which most of us will fall into.
Both Westley and TolduSo have posted the same messages on the Micon Arcade board which is why much of it does relate to their purchasers.

I am new to this site and have been reading others as well. Westley has a very valid point from what I can see. Sadly I did my homework too late and am now in the boat with you. I notice in all of these sites that there is no suggestion of getting rid of the hated FNs who have laid their money down, by giving them back their money and selling on to their beloved locals, who really deserve to own the land.
For those of you who want to stand up and be counted one brave soul has started an on line petition which requires 200 signatures to be picked up by a UK MP. Do go online and sign it, it may do no good but we can try. For those of you who still believe that you will one day 'own' your properties, indulge us poor faithless unbelievers and sign the petition. It can't do you any harm.

While there are a number of ‘owners’ within the development with ‘Deed of Sale’, there are long term issues that will affect us ALL. As there are a high percentage of FN’s within each development there needs a collaborative approach and response with the current chaos on ownership of property.
I have seen many developments that fall into complete ruin in Goa where the maintenance and repairs of such developments have been placed at the hands of just a few of the owners. No FN entered into this without either seeking clarity or business acrimony that owning property was viable. Why would any of us pay the freehold price for a 5 year lease? What will then happen in some cases in the next 3/4/5 years when there is the expectation for EACH ‘owner’ to contribute into the maintenance and society fund when these issues of deeds have not been addressed. Believe me it will be an issue for ALL.
There is though an opportunity that started with the US refusing to invest into either Indian business/ property if there is not a change in the current law. This has now been taken up by a number of UK politicians that are to address this issue with the Indian Embassy and Indian government. Can you please refer to the ‘BRITISH EXPATS GOA’ website under ‘BUYER BEWARE’ to support the current petition to be presented,

First of all, many thanks for your apologies which are very much appreciated and which I am happy to accept, and for the fact that you were prepared to voice them publicly on this board.
Like you, I want us all to use the board to help each other out and, as such, I think it is time to draw a line under what has taken place previously….the last thing we want to use it for is a slagging off match between individuals.
I take your point that everyone has their right to share information and opinions – perhaps we can come up with some ideas of how to resolve some of the burning issues, the question of rental fees being one of the important ones for most of us at the moment.
It would certainly seem to be the consensus of opinion that 50% is too high and, if it is definitely confirmed at this figure, perhaps we can think of some ways to organise rentals ourselves – Tracey has already suggested the idea of checking on each others properties which appears to be a very sound one. I personally have not rented out before as these are the first properties which we have ever purchased abroad. I was interested in renting our studio apartment out but dismissed this idea whilst in Goa as I was advised by Lorraine that the rental fee was much higher than the 50% that has since been quoted!
Regarding the utility bills, I will certainly want to see these myself as these will form part of the Limited Company accounts which I presume we will have to submit on an annual basis? It is my understanding that at the present time any electric costs are being met by Sanatan as the individual meter boxes have not yet been connected.
I also believe that we should all be involved in the Co-operative Housing Society which is being set up regarding the management of the maintenance fees which we will all be paying. This is not out of any distrust but quite simply that there will be a lot of money invested in the Management Company, and interest earned on it, and I think we should have an input into how that money is utilised after the general expenses for maintenance have been allocated and adequate reserves have been set aside.
Imran has come up with the idea of setting up our own Peace Valley web site and, whilst I am happy using this message board, I do think that there is a lot of mileage in setting one up.
Apart from the fact that it takes absolutely eons to upload photos on this board (it may be my pc, but it takes about 15 minutes to upload six and I normally try and put at least six lots on!) I think it would be good to be able to go to a section, for example, of where members have suggested good places to buy furniture, advice on setting up the Limited Company, or for advice and comments on our experiences of the purchasing process under individual areas – again, rentals would probably be another good example! This will save everyone having to trawl through dozens of messages to find what they want…
I know that there are quite a few people who actually read the board but do not post, and there must be hundreds of Peace Valley purchasers who have not heard of Eye on Worldwide but who may pick up a web site via a search engine, so it could encourage more people to join us.

Firstly, sincere apologies if my language / opinions offended members and it was not meant as a personal attack on Margaret - I regret that this has been taken that way but can I just point out message from Margaret on 28th March where quite obvious slating and sarcastic remarks and opinions are aimed at Mark Chambers and Aland and some of the comments made about me in some of the responses to my post . Point made and have no wish to fall out with anyone as believe we should all be helping each other out.
The purpose of a message board is for all members to post an opinion whether positive or negative and share information for the benefit of the whole. Eyeonworldwide is accessible to anyone who has an interest and is not owned by any particular individual. This should not be censored because it does not fit in with an ideal of a group or witch hunts directed at people who may wish to voice some areas of concern. Admittedly, was probably not the best use of words but pretty fed up with being taken for a fool and sorry but finding trusting these people more and more difficult.
I have spent the last few months arguing with the Kumars over money which I have sent that they claimed (until very recently) they have never received and then received a very rude telephone call from Lorraine offering rental which basically stated that it is 50% no discussion, take it or leave it! I also have apartments elsewhere in the world which I rent through agents and therefore have benefit of experience and this is a totally unacceptable and unfounded fee which people should be made aware of. You should also receive the utility bills yourself - it is your property. Agree with another post that people checking on your apartment for occupancy is a very tried and tested way of ensuring property is not being rented out without your knowledge. Whilst things never run smoothly which I am accutely aware and I still firmly believe the resort will be something special and a good investment, I have never felt the same level of misgivings about the dealings of a Developer when I have bought elsewhere. People should be made aware of various different experiences and be allowed to form their own conclusions.

Although completion is still a way to go(!) I will also be looking at furniture shops in Margao - has anyone started doing this yet and if so can you recommend any good places to shop for general furniture and kitchen fittings?
Also I've been thinking about creating a proper online forum for the Peace Valley community - e.g. www.peacevalleyforum.com. We could have proper sections for Photos/Legal/Furnishing etc and it would make things easier for members to search for topics that may have already been discussed. There could even be a section for "Latest Developments" that the Kumars and even Nelson/Denise could contribute towards to keep us up to date on how things are coming along?

Hello everyone on the message board
Well margaret it was great to meet you out in goa lol maybe next time we can try meeting down the stafford arms .
Well here is my bit to add to this Board
So after spending a week out in goa for the first time in over two years i was impressed with how its come along and seeing the stuctures built helps to give us all an idea of what its going to be like. The last time i saw the site it was bare land with only one show home as an example to other buyers.I have not come across any other development like this in goa not that i am an expert on goa but it dose seem to be one of a kind. My experance of the Kumars so far has been good admittedly the maintainance payment for 20 years is showing to be very unpopular. As buyers do we receive a certificate or something of the sort so that if we decided to sell the propertys at a later date the next buyer will not have to pay another 20 years maintainance fee i have not spoken with the Kumars about this yet because i am not at that stage.
I met Lorean out in goa when i was there who seems a nice person its good to have a british person there in my opinion as it helps with communication but Lorean is new on site and maybe has a few differant opinions than some of the buyers personaly i found her very helpfull and cooperative one thing i was a little concerned about was that the site was being marketed to russian clients. My thoughts about that was not so positive as ive found the russians quite antisocial but most other nationalitys ive found to be ok.
As for the rental program thay are offering in my opinion its a high price to pay but i will decide nearer the time what i will do with my investment there i might market it myself and find my own clients etc etc. As for my shop unit ive reserved the idea with the Kumars to open a cyber cafe ive had this idea in mind for some time but was unsure untill i had spoken to them.
so all in all i was pleased with my dealings with the Kumars but we still have a long way to go till its all finished.

i do understand what your saying about if they pay bills ect . we can`t keep a check on how many have been through our apartments ect . ( a valid point )
but your forgetting one major point .
the power we all have collectively . i`ll explain what i mean .
in my other rentals thier is a large group of us and when ever one of us goes over we check to see who has people in thier apartments . this system has work well for me in the past .
i can`t see why this system wouldn`t work here , also we email the site company to give permission for "so and so" to go in and check everything is o.k. ( if no one booked in ) .
another point to bare in mind in some countries your insurance is invalidated if more than one person has keys to the premises , so if the developer has keys and you then give some to the little old lady down the road to do the cleans where do you stand if something goes wronge .
personaly if only one person has keys then the buck stops with them . i hope i haven`t opened up another can of worms here i`m just giving you the benefit of my experience .
as far as the deeds are concerned we will hopefully have some news for you all soon ,

Hi All, am new to the board, would like to add some comments of my own, as there seems to be a lot of difference of oppinions over the last few months but no one has actualy any facts, so hopefully some of you will have all the answers to the below. also each member should be able to state how THEY feel about their experiences with dealing with the Kumars, without being slated.
Firstly we are not fans of the Kumars, we have found them liars,and allways trying to get one over on you. Does no one relise that whilst everyone is argueing over trivial matters the bigger issue is has any foreign investor actually received their DEEDS via the company route as i have read that a few of the investors have recently returned from goa with no mention of receiving their deeds (Im sure the Kumars have promised everyone that they will receive their deeds with arrogant jumped up Ankit signing on behalf of the company ((how thoughtful)) If any one has received their deeds (from mumbai after they have been signed by the registrar in quepem and then rubber stamped in mumbai) then I appologise. Secondly ask your self this why does Ankit have to sign on the companys behalf as foreigners are allowed to set up businesses and therefore sign for the company, unless the company has not been set up legitamately? This procedure with Indias, usual slow attitude to getting things done takes no more than two to three weeks. as advised by a non biased solicitor
Regarding the rentals, how can it be possible for a letting agency (lets call it this) charge 50% for dealing with rentals as the case is that you own the asset and without it there is no rentals therefore you take the bigger slice of the monies earned, also is it not reasonable to assume that if you or your company hold the title deeds surely your utility bills will be directed to you and you would have set up standing orders/direct debits? or maybe you plan to give the Kumars the ultimate power of attorney?
I look forward to reading everyones comment (especially the Kumars` fan club).

now think of something else sanatan sort out eleccy/water i take it for the 50% cut they also pay for it hmmmmmmm we never see a bill = no idea of when people are in the place or not call me synical but i have seen this used before...... 'no it has'nt been rented out for ages' was the reply and i could never verify because of the lack of bills. you could ask for a copy but isnt it hard enough or impossible to get a receipt for moneys already paid call me synical but bear this in mind they are very smart indeed and some on here are a bit gullible and very few companies charge 50% trust me i have 15 all over the world | at home with the kumars |

Dear All,
We have just completed on a 2 bed apartment in Bansko and the management fees in rental agreement is 50 %. I think companies have realised that a lot of people are investing in the rental market and are charging accordingly. There is not a lot we can do about it unless you want to leave property empty or use it personally, depending on why it was purchased in the first place.
Hope we see an end to the negative comments and look forward to seing a few of you next year.

PERSONALLY I FEEL ALL OF THIS UPSET IS TOTALLY UNNECESSARY .
I VERY MUCH DOUBT ANYBODY WILL BE RENTING THEIR VILLAS / APARTMENTS OUT FOR A WHILE AS THE COMPLEX NEEDS A LOT MORE WORK TO BE COMPLETED FOR IT TO BE READY FOR RENTALS .
I DO AGREE 50% IS TOO HIGH BUT WE`RE ALL ARGUING ABOUT SOMETHING THAT HASN`T BEEN SORTED OUT YET .
I ALSO HAVE OTHER PROPERTY RENTALS ABROAD AND I AM WELL AWARE OF THE COSTS INVOLVED .

Please don't apologise because you may 'buck the norm' - there is no one on the board, including myself, who would want you to agree to something just because the majority did!
However...what you have done is to set out the reasons why you are not happy with the rental situation and I can see where you are coming from, but as Tracey says, this does need more looking at once we have the final facts and figures.
What is upsetting is the tone and bad language of macfrith's posting, both to me personally, and to our other board members...

Managed to decipher your message eventually – can only assume that you were having a tantrum and stamping your feet while trying to type at the same time!
Personally, you can get as hacked off (think this means more or less the same as your vulgar slang) as you like with me….but I would suggest that it is déjà vu ….back to May and June 2007 when you last visited our message boards! Some things, or people, never change…..just the language apparently.
I take people as I find them!
Respect usually attracts respect, whether opinions differ drastically or not.
However, I find you uncouth and foul-mouthed and I would be very surprised if even some of our more militant members would condone your behaviour.
There is very little more that I can add to what Ken and Tracey have so eloquently stated, other than to reiterate that behaviour of your kind is neither needed, or wanted, on this message board.

sorry but i tend to agree with macfrith lets do some sums if you get 250 a week for your place 125 will be handed over equals 500 a month with approx 187 apts over 26 week let period is a whopping 2431000 for doing not a lot thats if ive done my sums right and the lot are rented out of course then you have your tax bill on top and suddenly its not too good.
nobody charges 50% i have other places around the globe i rent out and the norm is 15% i rent to thomas cook in greece and even they dont take that much so i can see where people are coming from and we do pay maintenance and in my experience an occupant does not use that much eleccy/water in a week so if you lot are letting and prepared to pay that much good luck to you all i shant be.
you can get a 'local' to do the hand over etc and before you all scream but how can you trust them denying for over a month money had not been received springs to mind (see earlier post on that 1).
anyway sorry if i tend to buck the norm and agree with comments made on here but being held to ransom over extortionate takes isnt on and after speaking to a few members personally (phone) from off of here there is a bit of dis trust between certian people.

i do NOT think your comments very accurate or constructive .
if you TOOK THE TIME to read through the board ( or can you only read / write swear words ) you will see the 20 years ( not 10 ) maintenance contract has been discussed time and time again . if you COULDN`T BE BOTHERED TO CHECK out your contract prior to signing it , then i`m sorry that`s YOUR PROBLEM !!! .if your contract states over 20 years then that`s how you will pay not all up front ,
have you actually been over and spocken about this to the kumars ?
we have recently returned from goa ,
had no problems with the maintenance , all the snagging done to our satisfaction , all items we ordered and paid for were in our apartment ready , all monies paid / owed tallied down to last rupee . and we were pleased the the apartment .
as for the rentals ,
the last i heard they were still sorting out the figures ect . i think you`ll find the 50 % was to cover all water , electric , gas , cleaning , laundry , breakages , advertising ect .
if you`ve had experience of property rentals prior to this you would appreciate that these additional costs are additional and not included in the usual 15 % . now i do think this needs more looking into but your upsetting people with this and no ones actually seen all the facts and figures yet .
as for lorraine , your entitled to your own oppinion ( i certainly have my own oppinion of you but i`m too polite to put it on this board !!! ) she has only joined them recently , i have found her very pleasant , friendly and helpfull . we`ll have to wait and see what happens with the rentals but during my recent discussions with her i felt she did know what she was on about and had plenty of experience . again , i feel your worrying and upsetting people for no reason .
AND FINALLY , WE COME TO YOUR COMMENTS ABOUT MARGARET ,
what right do you have to run down someone who has spent as much time and trouble as margaret has helping out other purchasers on this site ,

she is a very warm hearted lady who will help anyone . she is also very shrude and very clever and over the past 2 and a half years i have found her help and advise extremely useful .

i seem to think margaret is a big fan of the kumars for some reason god knows why they are a bunch of robbing lying b%$£"*ds trying to hold us to ransom charging 10 yrs up front in some cases (maintenance) 50% of rental funds may get a bit pissed of with this margaret but isnt 15% like the norm is else where all over the world they are greedy... the kumars and ......the lass lorraine f&^ck her too she is a puppet for them
