        This forum has gone very quiet of late,anyway I finally got my rent although it was £100 light. L I told me to find another lawyer as they didnt like the remarks I made about them to MRI.I probably wont sign another rent agreement.I am going to Palazzo on the 30th May and hopefully put a lock on the bedroom door.Has anyone else done this?I am definately within my rights as I own the place outright.but I wonder what will be the reaction of the management.If anyone else is going at this time I would be pleased to meet you .My apartment is 314 Palazzo 1.

                                                     PS.Can anyone recommend a competent lawyer.

   I have paid for my furniture but I still have'nt been paid my rent.I told LI  that I wanted to sue for paymentbut they just gave me the runaround.I reported this to MRI and got no answer ,what can you do?

Apparently this is the point the developer has made - he is not paying rental to people who haven't paid for their furniture.  If this is correct it seems fair enough.   MRI have said if people pay for their furniture he will pay the rental.  We have received our rental as our furniture was included in the price of the apartment.

Like everyone else on this forum i have been having a nightmare with regard to Palazzo. I see that some individuals have received varying sums of money in regard to their 2007 rentals. Can you please confirm if you have received rent that you had paid for your furniture. At this point in time i still haven't received any funds for 2007, though i haven't paid for my furniture pack. What is the latest situation with the developer - is he being any more reasonable? Do you know of anyone who has been able to sell their apartment and what is a realistic selling price giving all the hassle we all have been experiencing?grayso

Hi everyone I have bought apartments in Bansko from Platinum and we are having lots of problems with delays etc. I will definitly not be renting my property though a management company after reading through your forum. I couldn't find the name of your developer anywhere,I think most of them are tricky but I also have a studio near Albena  the developer is BLD and so far I have had no trouble with them at all. My contracts for the two developers were very different and I think it is a case of buyer beware when buying in a foreign country. I think perhaps we should be complaining to a higher level about the lack of regulation in Bulgaria after all they are still having to prove they are willing to tackle corruption as part of the conditions for entering into the European Union

Yes this is what I meant.  As regards the payment you got, I would ask the lawyer what has been deducted.  The developer deducted 10% for tax from ours, then his bank charges, which I said I wanted back.  We had already paid the maintenance charges.  The cost for these should be shown on your contract.  Ours were about 428 euros for one year.

           I have just received my rent for my 1-bed in Palazzo 1. Out of the €1500 I received €922 Does this tally with what everyone else has received? I presume the maintainance charge is €578 this seems quite high, what has everyone else paid?I haven't been contacted by anyone apart from Macanthony regarding the developer. Here is the text of the message from Dean masters for anyone who has not seen it, Izzy is this what you mean?.

We are pleased to update all of our clients on the latest information in relation to Palazzo development.

Recently MRI has been investigating three potential angles for a solution in relation to issues with the developer. We have requested that both your lawyers and our corporate lawyers provide us with legal opinions upon the following:

 

·          Unauthorised change of use:

“It is advised that as per studies of all relevant documentation, including preliminary & rental contracts, building & construction permits, resort plans and the Territory Development Act that the developer is not in breach of the preliminary contract as purchasers who have agreed to the developer renting the properties by accepting the rental agreement have agreed to their properties being used for hotel services.”

In summary, it is not recommended pursuing any legal action based upon this point as this would present a weak case if brought to court.

·          Non payment of rental:


“In the situation whereby clients have fulfilled all of their obligations and the developer has not paid the rental monies due, it is advised that the developer has not fulfilled his obligations to the client and such clients are recommended to make contact with their lawyer to start legal proceedings against the developer.”

Our advice to all clients is to contact your lawyer regarding your individual situation so as to ascertain whether it is recommended that you pursue a legal action or not based upon this point.

·          Retention of 51% of properties by the developer in order to force control:


“All decisions regarding the blocks of apartments are taken from the General Assembly of the blocks. In the General Assembly, each owner has one vote, irrespective of how many properties they may own in the blocks. The developer may have retained 51% of the properties; however he still only has one vote in the General Assembly.”

This final point is the most promising news as this means that the developer only has 1 vote in the General Assembly, even though he has retained over 50% of the units.

The result of this is that the community of owners can act together in a General Assembly meeting and vote to remove the management company if they are not willing to, or do not bring about changes of terms for all owners.

Given that so many owners are located outside of Bulgaria, we are suggesting clients sign Power of Attorney so that a lawyer can represent numerous owners at the General Assembly meetings and thus voting in accordance with their wishes.

It is with this in mind that we recommend you speak with your lawyer as soon as possible to make the necessary arrangements.

I have been told that all purchasers at Palazzo are being contacted regarding the problems with the developer being the management company and what can be done about this.  I would be very interested to know if anyone has received this information.

i own a studio apt in palazzo complex and have not yet got paid my 1500 euros rent yet.

I have tried to contact legal independence but cant get through,have e-mailed them 5 times in past month and no reply.I ve e-mailed MRI 3 times also and no reply.

it is ludicrous set up- ive asked mri to give us a name of another legal representative in one of my e-mails and also no word backi pay mri over 350 euros a year to work for me and sort out problems .i dont know what steps next to take.

i can see other people in palazzo are in the same situation from e-mails .we need to get together or get in contact and make sone form of decision here for our own sanity and make a stand.

nobody else seems to be bothered.

I have not recieved rental and will take Izzy's advice re daily phone calls to MRI and LI.

What have people deciced about this years season. We had planned to rent ourselves after all the hassle of very low rental income and still no payment  3 months after due date of 30th sept However MRI have said that the developer will go out of their way to be as obstructive as poss making this very difficult. I feel really backed into a corner now and wonder what others have decided.

We also got our apt surveyed recently for mortgage purposes and it surveyed for what we bought it for off plan in May 2005 - Major disappointment

Hi all

We have received our rental.  From the sounds of it we are the only ones.  I contacted LI on a daily basis until the rental was received.  I assume this must have had some baring on the matter.

If the developer doesn't pay the rental, then legal action should be taken against him.  It is a legal contract.  I don't know how things work in Bulgaria, but there must be some authorities who can be contacted regarding this.  He has rented out people's apartments, then kept the money, which is obviously illegal.

Has anyone completed in Palazzo 2 yet? We have been told by Legal Independence the apt are complete and we can close. That's all i have heard. I am very wary of putting anymore money into this development after reading all the comments. We were not planning on signing the rental as we thought this would stop the developer from renting without our permission. Looks like it doesn't make a difference. I would be very interested in joining any kind of owners group/forum. Please let me have details.

Hi All,

I am just reading new posts this morning.  We have not received the Rental income of 1500 Euros yet - obviously signing a contract regarding the renting out of the apartment and the payment of same before the end of September doesn't mean anything in Bulgaria.  I presume this money - if it comes will be paid into our Irish Bank Account. 

Ten days after the end of the agreed Rental period, there was people in our apartment, even though we had contacted Palazzo to tell them that our daughter and her friends were travelling out to Sunny Beach.  We live in Ireland and there is no way of supervising the Rental period, I think the best idea is to let family members and friends use it as much as possible outside the Rental period.

We have a mortgage for this property and thought fromt the high powered sales talk from MRI that it was going to turn into a very nice nest egg for the future.  We are in our fifties and will have to continue working for a long period of time to try to recoup our money from this purchase. 

Should we think about selling this apartment, I believe MRI charge a fee of 10% for same and also there would be Capital Gains Tax to be dealt with.

Hi there everyone!

We've received a letter from the builder in Bulgaria today demanding the balance for Palazzo 2 be paid within the next month or else we lose it. There is no mention of the amount they require! Shouldn't it be through the solicitor? What about recompense for the delay? We've not even chosen the kitchen yet?

Any Palazzo 2 users out there. Have you completed ? Did you get rental this summer ? I have 1 bed in palazzo 2 but haven't heard from MRI since around March (when development was supposed to be finished) to say it wouldn't be finished until June !!! Would appreciate any info !!!!

Hi all, I have just had a response from Legal Independence after several emails,they say that the owners have finished their tax report and will start paying the rent owed and will inform me when it is in my account ,they also say they dont charge for this service which is some good news.BERT

          Received a mail from solicitor (Legal Independance ) today saying that the developer is calculating the rent ??? and will be with the solicitor on Thursday to arrange payments. Here's hoping.

Hi all,I have just returned from Pallazzo,there were only about six people there,the restaurant was closed.The season finishes on the 30th Sep and opens again on the 25th May 08.They rented out two  flats to people that just turned up on the off chance I didnt get the room No's I had no complaints about my place,I think you have to go mid season to catch them at it. My husband and I have also purchased an apartment in Palazzo 2 and were told it would be ready in March, then June. Now it's the middle of September and despite sending numerous e-mails we are no nearer to completing - which may not be a bad thing. We don't know whether or not to just walk away (if that is legally possible) 'cos of all the bother with the hotel owner/manager. Actually, we haven't even decided on the kitchen yet, so it would be interesting to see what 'our' apartment looks like - if we do proceed we are tempted to leave it bare!! Remember there was a change in apartment numbers? Well I have an original drawing (Palazzo 2 only) showing all the apartment numbers if anyone wants to check theirs. What is the situation with the floor numbers though - does it start at 1 (our ground), I can't remember?

A Palaxxo owners club would be an excellent idea.

Its up to you what you do, if you choose to complete or not, no one can tell you what to do.

Hi all,

just found this site. I bought a 1 bed in Palazzo 2 in Sept 05. It was due to be complete by March '07 then I got a letter from solicitor saying it would be June '07 but I haven't recieved any other info since. Can anyone tell me is block 2 finished now ? Are there people renting apartments there ? At this stage I have payed 30% (approx E17,000) and am wondering if I should forget about it !! Any advice anyone ???

I have spoken to a fellow purchaser who has just returned from Palazzo.  A lady arrived when he did, only to find someone in her apartment.  She complained to the manager who said that it was an oversight and offered her compensation. 

The lawyer has apparently said that if anyone goes over and there is someone in their apartment who shouldn't be, see the manager and demand compensation.  If he refuses this, call the police.  He also said that the hotel has, by law, to keep a register of who stays in which apartment and when.  We are entitled to ask to see this.  This should help alleviate any problems on this front.

I also have to rent out my apt to make it pay, but the rental contract the developer offered is a joke, (Less than 2%)Thats way i rent it out myself i need to pay the mortgage. I may use strong words but they are true, i have pussy footed around myself  for long enough but now i have proof that the developer is renting out our apt without my say so i feel i need to take action. But i also feel that it would make a bigger impact if we all took action as a group. Im sorry if my words caused offence to anyone, but this developer as been a pain in my side for 2 years now and he is just getting worse due to the fact that we are all letting him get away with what ever he wants.  I have been intouch with darragh this week and had a reply today, i told him that i wanted to start a palazzo owners club so that we can fight the developer together and he said he would support us 100%. To start up the club i would need everyones contact details, i have started to put a forum together so that we can all have contact with each other and have our say.  I will let you have details of the forum when i get it up and running, To be honest im no IT person and not really up on the forum thing, but i am ready to try my best. Once again im sorry if anyone took offence by my words but i say it as it is.   I do have details for Darragh if  you would like to contact me bert i will pass them on to you.

Hi Jebs, good luck with changing the locks,it seems like a reasonable idea but for those of us who are hoping to rent out our apartments and have no contacts over there to help out it would be difficult. To have the address of a good management agency in Nesse Bar would solve the problem,do you know of one ? To accuse people of "pussyfooting around "is a bit strong, most of us just dont know what to do for the best,you suggested forming an owners club to apply pressure on MRI ,how could this be organised.Maybe some people would be worried  about the costs involved engageing lawyers,not wanting to throw good money after bad,for myself I think it has to be worth it.If you have any addresses for Darragh Mcantony,John Stapleton could you pass them on.Thanks, Bert.BERT

We have just found this site so this is our first posting.

We own 2 apartments at palazzo in partnership with my sister and her husband, we completed sept 2006. Since then we have struggled to get much info from Palazzo,Macanthony or the lawyers (despite buying aftercare package) My sister & family went in june (before rental contact) and both apts had been well used. Palazzo denied this, the table & chairs from 1 apt were also missing. despite promises from macanthony to investigate and get some resolution we have not managed to get answers. Would be grateful for any comments/suggestions from othersas we have felt quite alone in this till now.

Also there seems to be a lot of owners using this site. Can we get no's of owners involved or start some type of consortium/pressure group ??

hi all

I would like you all to know that i completed in palazzo 1 last dec.

We did not sign the rental contract and started renting out our apt independently, All has gone well untill i recieved an e-mail from a family in dublin who were allocated my apt by the manager of palazzo, the lady said she was in there for 11 days and then the manager told them they would have to be moved because the owners were coming. ( i had e-mailed him to inform him i had guests arriving in a couple of days)

I believe that hes filled our apt everytime we have not had guests in. I would imagine that i am not the only one, in fact i know i am not. The lady told me it had happened to other guests in palazzo, so it seems that he is filling our apts before his own.

I have informed my lawyer and he has sent a letter to the manager and developer stating that it is illegal and action will be taken if this happens again.

The only way anyone is going to stop this is by having the locks changed and having a local key holder. I dont know yet if this is going to be possible but i will let you know.

It also raises an issue when we come to pay the electric and water at the end of the year. and of course the abuse our furniture as taken this season.

I contacted budget travel today to inform them that there guests had stopped in my apt without my permission and without insurance, they did not care and said it was down to the manager of the palazzo not them.

We are putting up a plaque in our apt fixed to the walls and inside of the door to infrom anyone who uses it that unless they have booked through us then it is illegal for them to be in there.

Sorry to give you all the bad news but we are all been taken for a right ride by this developer.

Has anyone found a way to pay the Council Tax & Garbage charge rather than thru Legal Independance?

We've definitely been snookered with the rental agreement, but at least we can rent it privately after Aug 20th. Has anyone sussed out good rental sites & what to ask for per week?

thanks very much for the info as capital finance partners have been putting a lot of pressure on us to start the mortgage process. won't touch them now. can you recommend anyone else we might try? i have heard people say they are going to enquire re: changing the locks but have not heard of anyone actually mananging this. we have been trying to sell off plan for the last year with no luck. mcanthony have the apt on the market but i get the impression that they are not trying very hard. it all seems like a bit of a nightmare now.

2007 council tax + garbage =42

Legal independance fee =120

Has anyone who has bought at Palazzo or any other development paid their council tax and garbage tax.  The lawyers want too much money to do it for us, so we are trying to find out how else this can be done.  We would also like to compare what we are being told we have to pay, to what anyone else has paid for a 1 bed apartment.

hi just joined in on this site. i have bought a property in polazzo 2 but have not completed yet. i am buying with mri but dont seem to get much info or help.some of the tails iam reading are a concern. can anyone tell me the proceder for completion as i think it will be ready soon?do we as owners get papers to prove who owns the appartments?has anyone changed the locks to stop unwanted rentals?has anyone been out there and been met by people in there appartments?
