I am looking to purchase a apartment/flat in any of the towers, preferably on floors between 18 to 32. I am a genuine buyer and willing to close deal immediately at Rs. 1 Cr (all incl.). If you are genuine seller, please do not get misled by the hype created by Brokers and the builder of current rates around Rs. 1.3Cr per flat, fact is that NO deals are happening at these rates. Just in the past 3-4 weeks, rates have slipped from Rs. 15000 psf down to Rs. 10-11K psf currently and will continue to slide further. Since I have been looking for flat for past few months, the same brokers who were offering a particular flat to me at Rs.1.8Cr have started calling me and offering the same flat for Rs. 1.3Cr. My belief is that even 1.3Cr is unrealistic and rates will finally settle around Rs 9000 psf.

To cite recent examples, consider other premium projects like Rustomjee's ELANZA (Goregaon West) has come down to Rs. 9000 psf and Kalpataru's JVLR project has come down to Rs. 10,000 psf. Just until a few weeks ago, they were both quoting above Rs. 12K psf.

I am NOT a broker, looking to purchase for myself.

Hi,

Was really pleseantly surprised to stumble upon this site on the net.My husband and I have been fighting a lone battle with the builders for the last 6 months.It is ridiculous at the rate at which this project has been getting delayed.The latest salvo being VAT & service tax issue.

As of current status,I am assuming all the owners have signed the undertaking letter .

I personally met the executives on friday 13th june,to be told that the registartion of the undertaking letter will take another 2 weeks - so in effect the keys will not be handed over before July 1st week.What I endlessly argued was ,that since we had signed the undertaking documents ,& registration is only a formality,why cant the keys be given so we can start the fit outs.But the hapless execs in the office had no reply and their senior manager,a certain Mr.Prashant Bhatt is forever in meetings so not accessible.So there you go,further uncertainty.

I do not know if anyone has done this but we have issued a letter to the builders charging them interest for the endless delay in handing over the flat.Considering that they charged us interest everytime the bank emi cheque got delayed due to vagaries of courier service,it is only fair that we demand the same.Not to mention for the delay in getting the flat.

Lastly,I would like to be part of the support group for any action/contact with the builders.

Hi All,

I did a little research on Service tax liability for Flat buyers and found the following News Articles and also a Circular issued by india Finance ministry regarding the same.

i think the flat owners are NOT liable to pay any service tax .

Hello everbody

my wife was quite annoyed and surprised yesterday when she had gone to make the final payment that now they are asking to pay additional 1.8L against the corpus fund. Since as per agreement we have to pay only inr 60,000 as corpus fund and why now this, she has refused to pay this yesterday and also by some other people who were present yesterday at oberoi site office, I believe a meeting is being arranged on this friday with i think Mr vivek oberoi to argue on this issue and why to make this payment now for additional corpus fund which is being demanded. Sales person at oberoi was also saying that they may finish the intial corpus of inr 60,000 in next six months and as per their experiance then memebrs do not pay for the corpus funds once eariler one is over. But my wife argued with him that will be taken care by the members once flats are occupied by members.Builder has to stick as per agreement and only colelct the inr 60,000 corpus fund which each memebr has already paid. She has also asked them first to provide all details as how they will protect our funds for being kept agaisnt the vat and service tax with the bank before we can pay them.

You all can also check if a meeting is really being arranged on this friday with the builder.

The more the members are present we can pressurise him om this issue.

the final demand letters have been sent (as of sat evening, may 24). Posession for fit-outs will be obtained 4 days after 'final payments' are made.

The issue now is the amount of 'final payments'.

New surprises in the letter include:

1. An additional amount (1.8L) for maintenance

2. A 5% VAT amount to be kept as BG (bank-guarantee)

3. A 4.2% service tax amount to be kept as BG.

I suggest the following: -

2. Please also touch base with other owners you know to add to our strength.

3. Can someone suggest a property lawyer?

4. Dinesh - if you have been able to collect a list of members can we please touch base & build on it.

The pupose of the meeting could be the following: -

1. Talk to Vikas Oberoi directly

2. Go to the consumer tribunal

3. Go to the media

Look guys, if we delay this further, the seriousness of the issue will subside and only we will be the losers; so PLEASE respond so that we can act immediately.

I spoke to somebody in their sales office. the demand letter will still be delayed by a week.

Their new reason is an undecided percentage of VAT + service tax to be charged by the govt. on the agreement value. Any other owners facing similar situations. ?

I  suggest we all get together and hire a property lawyer to sort this quick.

Hi Everyone.. Pocession of flat is still being delayed.... It seems builder wants to get some more money under pretext of Service Tax,Vat...etc..

  So all of us should get united n oppose if there is any sort of money extortion activity from builder..

I have two apartments in the tower A and have been waiting on possession for long now. Oberoi's office has no answers to my questions now and they come up with creative excuses time and again.

All you other owners, what is the status as reported to you. Is there a possibility of gaining from the penalty clause?

work on the complex has definitely slowed down considerably. (not sure why so)

there is only a small trickle of labourers going in every day. (Compared to last year, or relative to the work left on the pool, clubhouse, children's play area, etc)

Not sure if that is on purpose (since OC is anyway delayed), or just coincidental?

anyways, we need to know more about this now.

the penaly clauses in the agreement are probably one-sided...in favor of the builder. A lawyer can better advice on that matter. (I am sure there must be a few buyers who are lawyers?)

There is strength in unity. We need to arrive as a  LARGE group at the sales office for us to get noticed.

The boys and girls at the sales office are of no use, but seeing a large number (say this sunday), they might call up some 'reasonable authority' at Oberoi Constructions.

Is it manageable to get together this Sunday morning? We need anywhere between 10 - 20 buyers together at the same time. (10 am or 11 am)

did any one seen the agreement? as the agreement contents several penalty clauses please comment if any one seen these clauses. Annexures are also not readable. People at marketing office are very unprofessional and dont have appropriate reply.

we have tried to get permission to start internal work on our flat at the tower A but they are flatly refusing to let us in - hope we get ur possession by end March - if anybody has any news of when we are getting possesion do let us know

Developer is simply saying they will give the possession after getting OC. I don't think they will give possession in March unless we all cumulatively pressurise them. All the builders give the possession for fit outs before getting OCs. I think before the end of March we should decide a date and reach at builders office and request them.dineshrj

Did anybody attended 2nd feb mtg . What was the outcome? Any reasons for delay in handing over found. When r they  going 2 handover.

There is a meeting in OW premises on 2nd Feb at 10 AM where selective buyers have been invited. I dont know what the meeting is about. If any of you have got the invite, kindly post here or email me what is the meeting all about? Why only a select few have been called?imad

Also, the Mar-April timeline seems to be a loose statement made by the 'boys & girls' at the sales office - nothing official about it.

We need to be physically present at the sales office in large numbers, and ask to see someone who has some reasonable standing/position at Oberoi Constructions.

There could be larger issues (i hope not) that we may not be privy to (e.g. issues with getting OC or any pending litigation).

e.g the nearby Oberoi mall has not opened almost an year and half after it was supposed to. (& it seems to be in ready state for quite some time).

The most disappointing part about OW is that there is no proactive communication from their side. They do not have the decency to send a letter/email informing us about delays

I think it is a good idea to get together and go to the builder.

I have tried talking to the builder but these guys are so unprofessional, don't reply the emails and don't talk properly when I call up.

I am so frustrated by these delays, when I bought in Feb'07 the possession was promised in July'07, then Dec'07 and now March'07.

I think we should all collectively ask for the compensation from the builder for this delay and for the breach of the contract.

i agree that the least they can do is allow interior work to commence at the earliest.

OW project hand over (possession) has been delayed further to April-08. All buyers should request for an early hand over for interiors purpose at least, as developer's internal work in flats is over.imad

does anyone have concrete information on the current status of Oberoi Woods (& surroundings) at this point?

e.g.

1. Are all the towers going to be 32 storeys each? (there was some vague info that B & A could be 34)

2. What is the ground (park/cricket pitch) that has been prepared behind tower C? Does it belong to Oberoi Woods or the proposed Oberoi School?

3. IS the July 2007 date still valid for possession?

Can some of us form a separate email group or chain so that we can discuss this?

Tower B 25 floors completed .No news for last 3 weeks. Internal work is in progress. I hope the project is not affected by the latest ruling on the forest land (10 km proximity ) and has got all the environmental clearances.

What is the latest booking rate?

looking at the towers from a distance it looks like towers A and B are now almost 23 floors tall, while tower C is still at 19. one can clearly see the difference in their heights....

but construction seems to be going on in full throttle....of course once the rains stop it will speed up even further.....
