There is an attorney called Michael Pugh of Walters Levine Klingensmith & Thomison of 1800 Second St, Suite 808, Sarasota, Florida 34236.  Their phone number is (941) 364 8787.  There are currently around 10 people interested in pursuing legal action against Superior and I'm sure they would welcome any further enquiries to strengthen the case.  The more people involved, the cheaper the costs will become as they will be split between all concerned parties.

We put 1st deposit down on 4 bed villa on Oakmont Restort some 5 yrs ago. We too, have been consistently lied to on virtually every occasion. Over the years they have hardly ever tried to communicate with us. We have tried contacting solicitors, but they appear very expensive and some suggested (about 1 1/2 yrs ago) that it is often very difficult to get back deposits in he US. It appears the contact is worthless from the purchases point of view. Now they have our money it appears they can just keep it for as long as they like (for ever?) without adhereing to the contract that they signed. We sent an e-mail off to a solicitor saying we want to sue, but we never here anything back from him. Either he is unindated, or he is waiting for something, or he feels it is a lost cause. There must be 100's of people in this position. Is this the only forum? What needs to happen is for a large group of people to collectively sue them. Any thoughts gratefully received.

      Superior news letter / emailed out this evening 27th june 2008 seems finally a little more positive .    They are  still in business and hopefull to continue with Oakmont and  more news promised in 90 days time on that development .  Regal Oaks looks to be legally ready now for hand over of 80 units completed or sold on as a first come first served basis .If any 1st depositors wish to cancel they will have there deposits refunded but only after lots are finally sold it seems .  [  With interest added  i ask myself ]            Regards  Birkdale                                                             Birkdale
Prospective purchasers may have been given details of extra property tax due on Oakmont  homes because of the CDD bond  which financed  the infrastructure. Owners on Calabria on Westside are currently paying $1350 per home per year. Oakmont may well be substantially more, and continue until 2038.

Can anyone confirm this?

I’ve found a couple of interesting Court documents on the web relating to this deal, filed in the Bankruptcy Court of South Florida which ultimately worries me even more..
 
The first dated 22nd of April 2008 is very interesting and my reading of this, and I stress I’m not a lawyer, is that Oakmont Grove Venture LLC is the owner of the property which if you look at you contracts is the name on them.  The link to this Court document is
 
What they were asking for was the possible release from the purchase agreements with Tousa if they failed to purchase the first 100 Lots by a certain date, which they have now failed to do.  As confirmed in this other Court order dated 11th June.
 
What the first document also indicated is that Oakmont Grove Venture have borrowed $5.2 M from Wachovia which matures later this year and a further $14.2 in a bond from Oakmont Grove Community Development District.  Oakmont Grove are liable for the loan, not sure about the bond though. It also indicates that Oakmont Grove Ventures are the ones that have completed the infrastructure and horizontal development.
 
So from my point of view they’re in a very tricky financial situation. My naïve logic suggests that they need to close on quite a few of our contracts quickly by finding another builder to start vertical construction and generate revenue to pay this loan, alternatively they re-negotiate the loan and extend the period of the loan but in today’s ‘credit crunch’ market that a) might not be possible or b) would be very expensive. I’d be a little concerned if a new builder suddenly stepped into this deal and started construction quickly, Superiors aim must be to get that extra 10% from us to service the loan and worry about finishing the houses later.
 
Not happy and very worried about losing my deposit.

Just received an update from Superior, here it is:

June 13, 2008

Dear Client,

Our last newsletter explained the position with Tousa. We outlined the time spent renegotiating agreements to be submitted to the various committees for approval under the reorganization. These new agreements were negotiated accepting Tousa's protection under their reoganization filing.

Having spent hours renegotiating and reconfirming contracts for the Oakmont and Regal Oaks developmentsas per Tousa's direction, it saddens us to inform you that Tousa has now rejected the contracts.

As Tousa has rejected the contracts we are now free to act outside the legal requirements of the courts. We have already commenced negotiation with the Oakmont land owner with a view to taking over the Oakmont development, building, and honouring all existing contracts and are negotiating seperate terms with Tousa for Regal Oaks.

We anticipate having more information regarding the negotiations by June 23rd.

Bought on both Oakmont and Regal Oaks over 3 years  ago . Deposited on both .  Been told basically lie after lie when trying to get a honest up date / on both developments . Do Superior own the land on these developments ??????    as last year i was given the opportunity by Greg Christner [ believe he as now left Superior ]  to move Regal Oaks deposit and  put  monies  with Oakmont  as no chance of refunds . Also to sign new contracts which i refused as why get involved deeper with an even more one sided [ superiors ] contract . Also was asked for a further 10% start of construction payment as far back  as mid 2006 on Regal Oaks  which they had not even started our property in phase E. Again i did not pay any monies . I am now looking for others like myself to join together / talk / discuss the next move on hiring an attorney  [ been  reccommended  several but again sceptical of these guys now from previous experiences ] .If you feel now you would like to move on to get your refunds back please get in touch .                    Regards    Birkdale

Bought lot on Regal Lakes,  however was told superior grp never had title to land.  They committed fraud.

I have lawsuit against them and court hearing is soon, if anyone would like to jump on board let me know quickly.

We were also sent a new 1 year contract - but have declined to sign at this stage.  This was to guarantee that ours would be one of the first 100 built.  Look forward to an update from Jenniferr!

If Valmeal is right I guess Vertical construction will have started!!

If it's of any use to anyone out there, we have just been sent new 1 year contracts to sign, the builders wanted them returned by 5th May.  We were told that verticle construction on village A and C will be starting in about 2 weeks time.

We put a 10% deposit on a villa in April 2004, then paid a further 10% "when construction started"!!  We visited at Xmas 07, and there was little sign of activity.  I also see that some people sued Superior early in 07, but don't know the outcome.  Every time we speak with Superior they say building is underway and promise deadlines that never seem to be met.  Given the current market in the US I wonder if our money is even safe! http://www.bizjournals.com/orlando/stories/2007/02/05/story12.html?b=1170651600%5E1411436 mwt999

I have just returned from Orlando and can report no work taking place on site. I was there for three weeks and checked for progress or activity at least five times and the site appears to be closed. I put a 10% deposit down on a villa in Oakmont three years ago and I really regret that now. The lack of information coming from the developers doesn't help the situation.

I placed a deposit on a villa here three years ago and have experienced nothing but delays and excuses. Every time I phone up construction is due to start at the end of that month. I would be interested to hear from anyone else who has bought here and especially if they have visited the site.colli1j
