Just came to know that the construction will begin only after August 2008 according to court decision.auzee

If construction has started again then its a risk on flat owners because Builder is going to ask for more money / installement and there is a high chance that more and more money may get stuck with builder. Has anybody visited the constructions site in last few weeks/months?

Nirma will certainly have to return the money, but that is not going to be at the current market rate and we loose here in a big way...I guess you are right  we have no option but to wait and watch.xcv

If GOVT has no option but to fix the issue otherwise opposition parties will take a big opportunity to stand by people affected by this ruling. It s a matter of 150,000 accounted people.  I suppose people living there may not be affected but under construction buildings may have to give up the ownership to forest department. In such case, Nirmal lifestyle has to return money to all flat holders.

The major loss is for people who paid lot of money to registration office. I believe other than this loss, the investment can be recovered from Nirmal.

At this point, better bet is to wait and watch next steps and outcome in Assembly. If the outcome is against builders then we have to chase up builder to return our money.

This is a big blow to all of us...Our Money is stuck, and not sure how long Supreme court will take on a decision..and what if the decision remains same ?

Any thoughts what we should be doing ?

FInally, A big example of Govt mess has been demonstrated... All current residents + new invstors who were dreaming to get into their new sweet home has been demolished...

HIgh court has declared all constructions plus already existing colonies as illegal.

Developers in the eastern suburbs find themselves in a spot because of the revenue department's laxity.

MUMBAI: The Bhabha Atomic Research Centre complex contains several buildings. But it's actually a forest. A Supreme Court order has left the status of several other institutions and landmarks such as Nirmal Lifestyle, Johnson & Johnson, Godrej Colony, ESIS hospital, Burroughs Welcome (now with the Oberoi Group), HP refinery, and even the Mulund BMC office hanging in the balance.

After the order on a Bombay Environmental Action Group plea, 710 acres of land in Mulund, Vikhroli, Nahur, Mahul, and Thane have been deemed forest land. A revenue department circular listing these properties as forests has put a full stop to all development work on these plots.

Developer Subhash Runwal said he was baffled by the decision to declare his 24,000 sq metre property on LBS Marg as forest land. "This property belonged to Rallis India, a Tata company, for 40 to 50 years. We bought it from them and have got all the necessary permissions: commencement certificate from the BMC, NoC from the collector, Intimation of Disapproval, and Urban Land Ceiling clearance. At no point were we told that this is forest land."

Thereby hangs a tale. While the forest department had demarcated this as forest land, the revenue department had not updated its records.

Why are they making this a cruel joke? After fifty years , they find this to be forest land in the middle of the city? Hard earned lifetime savings is locked in.

I think the hearing is all over now. Everybody is waiting on court decision. It will take around 4-5 weeks to get the decision. I hope by MID february we will see some progress.

There is no progress at site. They have stopped construction and slowly something is going on for podium but no progress since last five months.visakha



Last I heard was that they are waiting for court judegment. From Dec 11 TOI report, it appears that hearing was over in Nov/Dec  - I have not heard anything on the court decision. Does anybody know ? My fear is that even if court judgments is in Builders favour, forrect deptartment may take the court to Supreme court- which menas further delays.

Last time (May 2007) when I saw there were 4-5 floors being built. What is the current status of Amethyst?  I have been calling them / emailing them but nobody care to respond back.

It has been more than 2 years - Nirmal group has not been able to register any progress in the development of this property.  First it was approval  to cut the trees and then forrest  issue..the work has not progressed anything beyond 4 parking floors. On contacting management they have false assurances only.  I heard similar shall be the fate of City of Joy...Because they are not finding any buyer they are selling that on 20% payment only.xcv
