Hi everyone
What a nightmare dealing with M R I. Does anyone know if the other development has gone up in front of Nestinarka. Has anyone been able to acess their appartment. Hoping to go out in july to see for myself. Has anyone got a rental agreement with developer ? I have given up trying to get real information from M R I or Legal Independance.

Has anyone got pictures of the furnished apartment.
To my knowledge there was an issue with either a waste pipe or water pipe being in the wrong place and MRI were not fitting as the conection could not be made, I have been on to MRI and I was told my apartment would be rectified and the snagging list completed, cleaned and furnished by end of March. We have decided to sell the studio in Nestinarka and have asked MRI to put it on their resale list.
As far as we know the furniture has gone in but MRI are not very informative when it comes to the 'keeping us informed of developments' aspect of their aftersales service.

Just come across your forum - really interesting and informative. We have purchased an apartment at Bay View Complex but have never been to Tsarevo. Been checking the area out on the net but would appreciate any comment from those of you who have visited Tsarevo during the process of purchasing your apartments. For info. our complex is also running 6 months late due to building not permitted during the summer months for the 2 years of construction.
Any tips on Furniture Packages - Is it possible to purchace bedding / plates etc locally since these appear to be very expensive in the Packages.

MRI in their Lifetime membership fee includes 'Annual shorterm rental management fee' I wrote to ask what exactly that means and I got back a mail which I will copy in here.
I dont know would they find customers for us...

Hi All,
Nearly completed purchase in Nestinarka. Rentals!!. If we are so called smart investors then why dont we get together and form some sort of "Company" legally!!, where we can employ, possibly a chambermaid ie, someone to get an apartment/studio ready for guests who we could rent to. How do we get guests to rent, why not set up our own website and take bookings. Otherwise, we are all paying mortages on property with no rental income. Yes, I agree we could rent to family and friends, but that money will not covers mortage costs. If it is a holiday place then I could understand not wanting to rent it out, but I for one , would like to make maximum return on my gamble!! | Robert;b |

| To hudson, according to Carmen Lopez, if your contract does state that you will be given guaranteed rental, then the developer will stand by this. Not all contracts have this. Only a few people were actually told (and stated) in their contracts that they would receive guaranteed rent. I for one am not one of those people who would have received guaranteed rent. | Vicky N |

For anyone still seeking a solution for Nestinarka,,,ie an alternative to buying there....the person you should speak to is Corporate Director Steve Canueto on MRI's main number.He assures me he is very keen to find alternatives for those who don't want to complete at Nestinarka......he is also confirming MRI will support us in any legal action against the developer if buyers still want to go down that route.I am not trying to be a spokesman for MRI,merely passing on what he has been saying to me,and I do believe it is well worth calling him if you are still undecided about this whole fiasco. | seagull |
Hi all, have you decided whether you will complete or not? MRI Have given their clients the option of completing or purchasing elsewhere, i.e Portugal where they have said the Portugese developer will be clients who are leaving Nestinarka a discount of 15,900 Euros. The appartments in Portugal are 106,000 Euros. I have decided to complete on Nestinarka due to having put so much money down towards the appartment and for legal fees and furniture etc..
Carmen Lopez was meant to email everyone, however if you have not heard from her please do phone her. I did not receive an email from her (although she did say she emailed me), however when i spoke to her she re-emailed me details. Her advice is to complete, and to let the developer rent the appartments should you wish to, or sell them if you wish to.

Do we complete or not ?. Time running out!!. MRI advising not but t en we all lose deposits. If we complete we legally own the property, would that not be the better option. MRI explained to me today that we cannot take legal action against developr until we legally own the property , but if we do not complete then WE are in breach of contract . Real mess

no her advice is to complete but only to those that contact her
as she had,nt spoken to anybody else when i spoke to her apart from us two
so if you dont contact her she cannot advise you to complete

plus if the developer has these get out clause,s how come they never pointed them out to us surely that was what we had used them for

| Surely if MRI and LI are advising us not to complete the purchase they should also being giving us advice on how we terminate the contract and get our money back from the builder. This is an excellent open forum for Nestinarka clients to gauge the reactions of other investors, and allows the possibility of group action. (the power of the many).
Nigeldun is correct, there are many buyers who perhaps are not aware of this website. I know MRI actively monitor it, and so probably do LI and maybe even the builder.
MRI should contact all other similiar agencys dealing with Nestinarka, and inform them of this website. Our Lobby is strongest if everyone is onboard.
MRI are a big player, and their reputation will go down the toilet if this does not turn out well. In the end they will loose a lot more than we will.

Page 4 of preliminary contract
a) to present to the buyers..............................................approved artitectural design (which one??)
b) all information regarding the property, subject to this contract is true and complete and the seller did not miss to inform the buyer about the existence of hidden defects (what a joke!)
2) in case the seller fails to fulfil its obligations....refuses execution of this contract or concludes whatsoever other deal with this property without the written consent of the buyer, the latter has the right to terminate this present contract unilateral without a notice and free itself from its contract obligations, as in this case the seller shall refund to the buyer all payments made to him till the termination moment, as well as to pay a penalty amounting of agreed earnest within 14 days from the day contract was terminated.
page 7 (4) All notifications........................................................For every change the seller shall notify the buyer or proxy within 3 days.......................
14 (f) if upon accepting the constructed building it becomes clear that the activities carrried out do not correspond to contract.........Buyer has rights under Article 265 of the Obligations and Contracts Act?????

| Have been following with interest details on this website in relation to Nestinarka, we have purchased 2x1 bedroom apartments there and were also informed that we would have a sea view, hence our reason for buying in the first place. Just wondering has anybody been contacted by MRI about shifting their investment to Portugal. Our dealings have been directly with MRI and Legal Ind. we will not deal directly with the builder and furthermore will certainly not be handing over any more money until such time as we are 100% certain that every thing has been signed off, this includes the Phase 2 development ground, our information is that the builder is at fault for trying to implement Phase 2 thereby changing the plans and maybe in breach of contract, this is where Legal Ind as our solicitors, should be representing us the paying client. With Phase 2 gone, we most definitely should not be handing over any money until satisified. If MRI want us to have trust in them as a reputable overseas property company, they must step up to the plate. We should be offered the opportunity by MRI to be flown over to Bulgaria free gratas and a conference held to inform investors what the hell is going on. I need to actually physically see the site because at this stage I find it very hard to believe what all parties are telling me. Also wondering did anybody receive a reply from Darragh MacAnthony? | No e-mail was not from LI but direct from builder, do not know how he got my e-mail address. Message is threatening to cancel contract and take deposit as forfeiture if balance is not paid over within 1 month. He seems to overlook that he has breached the terms of the contract by deliberately misleading us in the description of the location in the contract. | When Nestinarka says he has had e-mail from the builder,does he mean the one we should all have had by now from LI ? If so,the advice is basically to ignore it......LI and MRI say this just a legal requirement and that there is no question of any buyers having to pay over any more money until EVERYTHING in the contract is delivered.We have had a much more positive contact with LI through office manager Carmen Lopez and suggest we all deal through her now. | seagull |
