Quick correction to the figures for Savoie Cofic quoted by me in the previous message:-
165 euros/year hence for three years - 495 euros in total including reclamation of the TVA and all accountancy work.

Hi, Im Rob from moving-to-france.com As you've quoted us below I thought I would clarify a couple of points. The contracts for Jasses de Camargue were very unusual. The following phrase is not often found in a leaseback contract:-
AVOIR
CONNAISSANCE qu'afin de pouvoir disposer des locaux à
l’expiration dudit bail, le cas échéant, et de
lui assurer toutes garanties à cet égard la société
venderesse s'engage vis à vis de lui à obtenir du
locataire la renonciation au bénéfice du droit au
renouvellement ou à supporter seule toutes les conséquences
pécuniaires qui pourraient résulter d'une demande
d'indemnité d’éviction réclamée par le
locataire et s'engage en conséquence à rembourser à
l'acquéreur ou à payer pour son compte l'indemnité
qui pourrait être réclamée. Le tout sous
réserve des conséquences financières liées
à la TVA (Art 210-1 de l’Annexe II du CGI).
A
cet effet DONNER par avance tous pouvoirs à la société
venderesse pour transiger avec le locataire en vue de parvenir à
la libération des locaux à l'expiration du bail.

expiration of the aforesaid lease, if applicable, and assure him all
guarantees in this respect the Vendor company engages itself to him
to get from the tenant the waiver to the benefit of the right of
renewal or to support alone the financial consequences that could
result from the demand for an indemnity for eviction claimed by the
tenant and undertakes consequently to reimburse the buyer or to pay
for his account the indemnity that could be claimed. Under
reservation of financial consequences concerning the VAT (Article
210-1 of the schedule II of the general Code of Taxes) In
this end GIVE in advance all powers to the vendor company for
negotiating with the tenant in order to get the liberation of the
premises at the expiration of the lease.
this means that Cecim the promoters are guaranteeing an easy exit at the end of a lease period. Of cours if they go bust.... but it is unlikely. this is the first time i have seen guarantees like this from the promoters( not the builders and not the rental management firm). For the tva reclamation and annual accountancy fees, Gefi and Eurefi were put in as the default cabinet at the last moment, which I regarded as being unfair on our clients and hence intervened with Cecim and the notaire in order for our clients to use a different Cabinet of accountants - Savoie Cofic, at a very much smaller price - three years including TVA reclamation for 395 euros in total (165 per annum). savoie is one of the largest firms of accountants specialising in leasebacks.
However the choice not to use GEFI had to be stated before or with the procuration, and Thuret's office has attempted to ignore some clients who had properly declared that they wished to use another cabinet. this we resolved for our clients. However now is the time to make sure that you have been in contact with your chosen firm of accountants. The reclamation actually takes place just after the delivery date, then it is just a matter of waiting for the french government to cough up.
On Elithea, we are in contact with them , but not having a much easier time than any of you in securing bookings this first summer for our clients, but we will persevere :) You will be surprised how quickly it is finished - France is nor Spain Best regards and good luck, Rob from the French Property Company Ltd.

| awaiting contracts as I type this . It seems to have been a long wait since I put down the deposit in late 2004 . I hope it proves to be worthwhile - I am hopeful .I believe that any units that have come back onto the market are 10 000 euros more so at least there has been some growth . | beeb |
