I have been very patient but can t take no more of their lies and empty promises.and now this..censorship.
I am not going to stand idly by while they ruin mine and other peoples lives.
If I don t get what i want soon there will be a plague of message boards and forums all dedicated to the demise of tds and their agents.
I have over 120 email adresses of interested people on this.

| If you log on the TDS site it might make for some interesting reading! We have two units at TDS which we purchased about four years ago so you can imagine how we feel! I feel things are coming together now and I have much more confidence in the project than I did. We are awaiting a refund on one of the units but we have only just sorted this out and we have been promised a refund within 120 days. The project at TDS and JDS is huge so I think we have to be a bit patient, I do know of people that have had refunds so keep your hopes up. We may sell our other unit but I would like to rent for a year because of the capital gains tax. We are having a meeting next week with TDS so will update after this. We also spoke to a UK property lawyer before reloading and he said stick with it so we will just have to wait and see at £200 an hour he had better have been right! | chick |
Thanks for your message. My contract has a clause in it that completion would be 2 years from date of signing - long since passed. I have been offered a place at TDS but am due to speak to the owner relations at JDS/TDS. Any further advice would be welcomed - any examples of where people have got their deposits back would also be greatly appreciated.

| Unless you have been asked to reload OR have your money back like us at TDS you will find it very difficult to get your money back. If like us you are asked to reload you will then have the choice to have your money back or go with the new contract. Your contracts may be different to ours I am not sure when you purchased your property there maybe a clause that if the property is not built by a certain date you can have your money back. You have signed a contract with JDS so you are binded by this! | chick |

To those of you that have had your deposit returned or are in the process - what are you doing with the cash now?
Don't be put off investing in the US just because of our TDS experience. I have recently come back from Tennessee where there are some very good investment opportunities.
Orlando isn't the only area that has a thriving tourist business. Tennessee offers good value projects, low property taxes, lower insurance (no hurricanes) and has four very distinct seasons. 75% of resident Americans can drive to this area within a day, its very accessible.
If anyone is interested send me a personal message and I can direct you to 1 particularly attractive opportunity (I have invested myself) to be built be a reputable builder for a developer that has a track record of building successful resorts. It is being marketed by an established company and buyers are not being asked for a whopping 20% deposit. It is everything that TDS isn't - a professionally managed opportunity.
Anyway there's no harm in looking at some details.

Has annybody any new information regarding Jardines Del Sol e.g. deposits, dates, sales activity
It would appear that Tierra Del Sol owners are reloading or getting their deposits back. It is clear that Jardines Del Sol owners have not really been addressed yet and that the very optimistic opening dates are late 2008.
There is still no mention of JDS on the website.

| Well - its not strictly true that they have not built anything yet; I met with Richard Davis of TDS at the site two weeks back and they have a lot of 'infrastructure' work done - that is the horizontal part that doesn't really excite people but is progress none the less. Plumbing, grading, foundations, electical, water supply are all necessary and there is substantial progress on that front. Agree though, that is not 'finished units'... | fdreano |

This is precisely why I'm suggesting that you meet with the TDS team and hear what they have to say from the horses mouth. You will at least then have an understanding of why there have been such long build delays. You can still disagree but you will in an informed position rather than just ranting blindly to people who have all been (or still in) your position.
If you speak to them they will also tell you how you can get your deposit back so take a deep breath, pick up the phone and make an appointment. | rohan |

Do yourself a favour and meet with the TDS reps. They will put you in a much more informed position regarding how TDS is going to fit in to the housing market.
The fact is the development is being designed as a "Hotel" project and not a normal housing estate. You cannot judge this development alongside a street of Villa's with "for sale" signs outside. If you want to jump ship that's fine, but don't make the mistake of refering to those who wish to remain in the project as "Mugs". There are some wise heads on old shoulders involved who may take it the wrong way. A word of advice, you should probably learn how to navigate your key board before trying to navigate the property market.
To all those "Mugs" who are staying in, I will see you in the observation tower for a well earned pint, and we can wave at Advocate as he drives up and down 27 looking for the next "zero risk, sure thing". | rohan |

Luxury Brands: Life in the Fast Lane
As the lodging industry’s current positive cycle matures, most segments are enjoying the benefits of strong fundamentals, which lead to future increases in supply. One segment, however, stands out as the leader in both recent performance and supply growth. According to Smith Travel Research, the luxury hotel segment has led in occupancy growth, and is estimated to have achieved demand growth of approximately 2.0-2.5% and rate growth of approximately 9.0% in 2006.4 The luxury segment, the smallest of all lodging segments, with approximately 80,000 rooms nationwide, is rapidly expanding and leads all segments in terms of net supply growth as a percentage of existing inventory.
Fueling the supply growth is the continued expansion of a number of Asian and Middle Eastern luxury brands into Western markets in an effort to diversify their customer base, increase brand awareness, and tap into the lucrative U.S. market. Since Western luxury brands have a strong presence in major U.S. markets, developers, investors and lodging operators are considering expansion into secondary markets. In addition, given the opportunity to add luxury hotels in some gateway destinations, the industry is witnessing the merger of landmark luxury properties into international brands, to penetrate additional niche markets.
While improving segment fundamentals is undoubtedly the main driver, other factors are also worth noting. The appeal of owning luxury assets associated with exclusive brands continues to attract “ego” buyers; from consumers’ perspectives, luxury hotels bode well with the trend towards the sale of lifestyle hotel experiences: creating unique guest experiences that are reflective of their way of life, self-image and interests. Further, given that it has been very difficult to build luxury projects today without a residential component, the trend in luxury hotel development has been partially fueled by a hot residential real estate market.
Overall, while some concerns are cited about the depth of the luxury travel market to sustain such fast paced supply growth, the segment appears to be poised for continued strong performance. With a customer base that is anticipated to continue expanding (for example retirement of baby boomers and the associated increase in their travel activities) and which is comprised primarily of affluent individuals who are not as price sensitive, the luxury segment appears to have open roads and clear skies ahead.

| It took 2-1/2 years to build my personal home due to local permitting (4-1/2 months of idle time just to get the seawall approved through the environmental authorities!) and then Hurricane Katrina restoration sucked all the labor pool from Orlando. But now, with the market off its peak, there are plenty of tradesmen looking for work so there shouldn't be an excuse for TDS not to roll forward quickly. I just found this forum (and the Tierra Del Sol forum) so I will try to check in weekly and give the local slant on things... Yes - I just wish I would have checked the box that said "put my deposit in escrow" rather than having the developer use it but live and learn I guess. I do now actually feel better about things than I have in a year or so as I have points of contact and information is flowing so we'll see. I didn't opt for the 'reload' as I recently retired and will not take on the extra debt. I also am about 50/50 for staying pat or trying to force a deposit refund. I will say that there is nothing close to the amenities this project will have if it gets done as advertised so lets keep our fingers crossed....I'll be watching closely. | fdreano |

Well I live in Clermont, FL a few miles from TDS; I signed up for a Milano unit in Jardines Del Sol (across the street from TDS) in May 2005. My contract has an 'unconditional' build completion date of two years....which will not be met so I am asking a lot of questions. I drive by the site regularly and have to say at least some things are happening now and once the platt gets recorded I think progress will ramp up (and the developer is at least talking to me again!).
I have a substantial down payment at stake (in US dollars of course) so I am monitoring closely. If, after the platt is recorded and before my contract deadline arrives, they aren't moving out smartly I'll pursue a refund (with an attorney if needed).
Two things to consider - I have built a $1M US lakefront home in this area and know first hand what problems the local authorities are in permitting and code changes, etc. so Malcom & Co. are being honest about that. Secondly, my wife works on Disney and the 'back gate' plans are going to benefit that whole Rt. 27 corridor in a huge way. So I am trying to avoid any rash decisions for now. | fdreano |

I think what is happening is that the webcam is broadcasting on a 'loop'. Like in Mission Impossible TDS have made a short film which they show over and over again giving the impression that nothing is happening.
In reality the resort is finished and they are just putting the final touches before turning the camera on and 'surprise surprise' - it was all a big wind up. The 'pranksters'.
We can all pack our bags and holiday together and how we will laugh around the ('much larger') waterpark and the ('much larger') pool bar sipping a cocktail ('much larger', of course).

I met with Russell Pierce last night, and much to my surprise, Malcolm Wright was there.
Malcolm spent all of 3 hours (I kid you not!) telling me the complete history of TDS from his early vision in the late 1990's to whats currently happening, plus how he sees the resort developing. He explained all the delays and problems that the development has experienced over the past few years and also why the prices have increased significantly. I am not passing comment or opinion on what he told me.
I don't propose to attempt to recount what Malcolm said but he did confirm that he will be coming to the UK to meet us. The plan is that he will come over mid-March and every 3/4 weeks thereafter and will visit several locations around the UK.
TDS will be emailing all buyers in construction order inviting them to meet Malcolm. They will ask each of us to r.s.v.p so that they can 1) judge numbers to make sure the venue is adequate and 2) make sure they have copies of documentation for each person who turns up.
This is our opportunity to hear straight from Malcolm whats happening, and to pose our questions. He will get someone from the mortgage co. there also (and possibly someone from Sonesta). We have all called for him to come to the UK and explain to us whats is happening, he has agreed so lets not miss this opportunity. When you get you email please reply and endeavour to attend a meeting. If you can't attend then post your questions on this forum and I'm sure someone who is attending will be happy to ask it (provided its a sensible question)

Look this is serious now ..Malcolm &Co MUST come over to the u.k. for a sensible meeting. even if it s short and sweet or at least get more involved with these forums.They can no longer be autocratic about this.Yes you are accountable to us.
At the very least a new update on tds should be posted monthly with photos.Don t keep us in the dark as this breeds discontent.Demonstrate your integrity and professionalism...there are far too many building scams going on in florida and the u.s. at the moment....all we want is piece of mind that the hard earned cash that we and our families have worked so hard for and have handed over to you is safe...is that too much to ask.
Peoples nerves and tempers are getting freyed , one of the best ways to alleviate these fears is for the people at the top of this project to be more accountable with what s happening with our money. If you have been told that "400 townhouses in operation by the end of
the year" and "the whole complex should be finished by May 2007" does
it not seem unusual that the webcam which is on the site has not been
made live so we can see building progress? I should have thought that
this one simple action would go a long way to allay many people's
concerns.
In response to your question, I strongly suggest that we have our own
independent lawyer present who specialises in American property
contract law.

I will post on hear some time monday after i have spoken with Malcolm. On a more positive ( without sounding nieve ) i am more confidant that the resort will be built and will be a premier resort after speaking to Malcolm.
From the conversation TDS was announced to the world in Malcolms words last week at the Florida Huddle. He said the pads for 48 units have been poured with 400 townhouses in operation by the end of the year. The whole comlpex should be completed by May 07. The upgrades for the resort are impressive and would take me to long to go into this although i have this written down.
What is also positive is that i spoke with floridahomes4u yesterday who are UK based as they were advertising townhouses. The lady owns one herself and told me that two sold last week for $610.000

you may be right. I have been offered a unit on the main TDS resort because I do not want to wait another 2 years for JDS to be built. The developers are adamant that JDS will be built but I'm not so sure.
If they can accomodate all JDS buyers on TDS (replacing those that will not relaod) I would guess that they wouldn't build JDS, although they may want to do something with the land.
My big concern is that they still go ahead and build Bella Citta because I think this is essential for the corporate market | garydove |

I think you are correct the way forward is to have Malcoln Wright, a Sonnesta represnenitive and a independent lawyer at a central meeting place and try to move forward.
There are to many rumours and half truths being told, we need hard facts.
It's a pity the whole thing has turned into a sham, the orginal concept was good and I don't think anyone was foolish enough to think they were going to make a quik buck out the scheme but just a solid investment.
On a personal thought I think they will not build Jds and that you will be offered a place in Tds.

Hi Everyone
Just come off the phone with Malcolm Wright president of American Lesiure ( TDS ) malcolm spent over an hour filling me in on TDS from start to now. I have asked Malcolm if he will come over to England to address the concerns we all have. he said he would ( a date and place to be arranged )
I learnt more from Malcolm in one hour than i have in the last two years from speaking with realtors etc... i came off the phone confidant that TDs will be built and with a better undersatnding of the situations that have taken place.
My feelings are it is better to get the facts direct from the president rather than all this gossip that can be percieved differently by each one of us.
