Sorry I've been on holiday for the past week, but sadly not Cyprus. I don't have access to the options that Athena sent me tonight but will post these as soon as I get access to where I've stored the photos. There was no further charge for the options that I have chosen, I don't think there will be even if you decide to go for non standard tiles and kitchen finishes, not sure 100% though.

Although I feel that this development still has some way to go, its nice to see that some of the options are being sorted out. I am a little confused as to the charges for the options - could Elaine (or anyone else) offer some advice as to what options she has chosen and what she is being charged for them?

HI,
If you are buying for investment and to let out Athena advised using the standard finishes as these are better to maintain, replace and are easier to find. As soon as you move to colours and / or different designs, they become a maintenance headache. There are still 4 types of wood to choose from for the kitchen door front, two types of granite and two colours of tiles for the bathroom. For the floors and the balcony there was only one standard tile. Although there are many more designs and colours available if you want to go for non standard options.

Hi,
I've now picked all my finishes, tiles, worktops and kitchen unit door fronts. It all seems so real now. I must say Athena from Paschali Developers has been very helpful in pointing me in the right direction of what will work best for investment purposes. I was really pleased to see that they use granite worktops in the kitchen. They are so much more hard wearing than laminate or wooden worktops and look so much better.
Now I must think about the furniture packages and what will work best.
Yes I agree the photos are of Block C, I have bought a one bedroom apartment in Block C and I can pinpoint which one is mine!

Athena from Paschali Developers has just sent me more photos of the site. Progress is really coming on now and the ground floor looks nearly built. With all this rain we've been having recently it was good to see the sun shining at least somewhere.

I have posted five progress photos on the 'progress photos' website. I just received them from Athena, Paschali Developers. They were taken on 4th July, and more photos should be coming at the end of the month.
It looks like the road infrastructure is being put in place first, although actual building work has not been carried out as yet. I will post more when I receive them.

I do not find this new news surprising - just glad that the courts in Paphos do not think that solicitors are above the law. Also glad that she is off the roads and did not harm a child or adult in a road accident. I do find it surprising that the other solicitors in Paphos were actively trying to appeal to the President - I wonder if they would do the same for one of their normal clients. Still, this must send a message about ethics, professionalism and honesty.
On a different topic (I think) - any news if the invisible machinery ever got to the development. Are we likely to have a development there in the next...lets say.. 2 years?!!

I totally agree with your advice. My experiences of buying through the MRI recommended solicitor are well documented on a number of websites, as well as a written record with my INDEPENDENT solicitor. So, I can always prove that my experience is genuine. In fact this written record, including dates of key events, meetings and decisions, will also be useful as I take things further.
I would also say that if you prepared to be led by the nose as you loose your hard earned cash, then don't bother complaining or making a stance. My viewpoint is simple, if you can't stomach a fight - don't bother buying in Cyprus. There are many other countries that can offer a safe haven for your hard earned money without any hastle whatsoever.

MRI currently recommend TALA DESIGN VILLAGE on Mesogi Avenue, Paphos, for the furniture package which looked reasonably good quality when we were taken to see it earlier this month but I have no idea how it compares with other providers of similar packages. We have no further interest in this recommendation, however, as you have probably realised.
However, a quick word of caution to all of you using this forum. Only truthful and verifiable experiences of using MRI, Paschali, Lemoniati, et al should be posted on this message board to avoid making any statements that could be actionable by Paschali's lawyer.
If in doubt, always seek legal advice from an INDEPENDENT law firm.

As Nigel Howarth from the Cyprus Living website said many months ago "If its any consolation, you are not the first and will probably not be the last". Hopefully, thanks to the Internet, there will be less people in my situation as the years go by. I complained to MRI but got nowhere - in fact since then have taken my business elsewhere. I have all the details for the Cyprus Bar Association including costs (which are very reasonable) and procedure - if you want these send me a private message. I have spoken to our mutual excellent lawyer and have been advised best to wait for the clauses in the contract to start kicking in before taking things any further - so am sitting tight till next year.
Fortunately, I am in it for the long haul and wasn't going to rent the apartment out anyway, so finances are not the problem. I do agree with your sentiments concerning Paschali and they have a good reputation (so far!), but do find their choice of bedfellows intriguing.
Thanks for sharing your experience on this website. I am always willing to share my experiences and consider the effort worthwhile even if it prevents one other person getting into the same situation.

Hello Ash,
You'd better stick with it now and hope for the best. It is unlikely Paschali will go bust and lose you your investment but very likely they will be late completing the development and hence lose you your rental income in 2009 if rental is what you were hoping to achieve.
The contractual damages payable are woefully inadequate but Paschali have refused to increase these when I challenged this clause in the Contract. Your independent lawyer (who incidentally we now both share) is best placed to advise you whether you can sue for consequential losses.
I am also planning to complain to MRI and the Cyprus Bar Association about the contractual misfeasance we have encountered, so I wish you every success. | monk.com |

I wish I had your foresight when buying through the Paschali/MRI/Lemoniati triad.
You just have to look at the situation at Christina Hilltop. So far we have had:
1) Most of the money for the apartment given to the developer, thanks to the original legal advice.
2) Flitting from site cleared, to not cleared, to heavy machinery on its way and email down but able to put messages onto this discussion board!!
The fiasco continues.

We have had to cancel our purchase on Andriana 2 since the Contract of Sale with Paschali had about a dozen unacceptable aspects which left us with little or no legal protection if, for example, the developer went into receivership having drawn down most or all of the stage payments which were allocated by dates rather than by percentages of completion.
MRI told us while we were in Paphos that Andriana 2 would not be started until this time next year. This meant that according to the Contract, Paschali could draw down 60% of the purchase price (which includes their own profit of course) during the next 12 months to add to the 15% deposit (which, by the way, we refused to complete) thus giving themselves a total of 75% of the purchase price without even setting foot on the construction site.
Having discovered, as you have, that there are other aspects apart from the Contract which give real cause for concern regarding neutrality, we have dismissed Lemoniati lawyers this week and have instructed alternative lawyers in Limassol who we know from our own due diligence are totally transparent and independent and who are astonished that MRI are still taking clients to Lemoniati. (Try searching Lemoniati on Google incidentally)

I would wholly agree with the 'independent' solicitor caveat - be strong and if you haven't got the time, hire someone strong. That is unless you want to be lead around the nose by a developer. Hopefully things change for the better as each developer is caught out and rogue and dishonest solicitors loose credibility.

Those of you who have a Contract of Sale with Paschalis Holdings Ltd will be interested to hear that clause 16.5 has apparently been outlawed by the Paphos District Court in a successful test case where a Developer was ordered to reimburse a Purchaser the cancellation charges imposed for re-selling the property before getting the Title Deeds.

Your Contract of Sale should tell you (usually around clause 6.4 on page 7) how much you can claim per month from the developer via your lawyer. If your Contract states €341.72 as most do, this is woefully inadequate and should have been negotiated upwards to the sort of rental income you would expect on average at the time of year you would have been letting the apartment or living in it if that is your purpose.
There is the possibility that you could sue the developer for 'consequential losses' which would be the difference between the damages available to you and the rental income you might have expected. However, in the UK this is not usual because the liquidated damages should have already taken rental income into account and is a pre-agreed level of compensation acceptable to both parties once and for all.
Alternatively you can accept another property to the same standard but, if the whole site has not been started, this option would not be worth the paper its written on! Which is why it is important to get INDEPENDENT lawyers to act for you as most others are in some way seeking repeat business from developers they currently have on their books.
The delay at Christina Hilltop Appts. appears to be entirely down to the expansion of the development at the initiative of Paschali as there were insufficient studios for the demand. | monk.com |

My wife and I visited Paphos last weekend as guests of MRI. We were interested in buying a property in Andriana 2 which we eventually did but during our visit we were taken to Christina Hilltop to view the site you are all concerned about. It was abundantly clear that no work had started and it was hard to see how this site could be completed by early 2009.
We were offered two additional studios at Christina Hilltop and were told these were extra studios to the original planning consent which was why there was a significant delay to the project as the swimming pool had to be relocated to make room for these studios and a futher tier of apartments had been added above the topmost tier on the original Hilltop plan. We liked the view but did not feel inclined to add two more studios to our portfolio at that stage.
If as seems likely there will be a significant delay to the completion date, the developer has 45 days further 'grace' after which he can be charged liquidated damages according to the Contract of Sale. Hope this clarifies some of your concerns. | monk.com |

Some good news!
My sister went to the site today. All the scaffolding has gone and the site has all been marked out. So it looks like work is finally starting.
When we spoke to Athena a couple of weeks ago she said we could expect to see foundations going in by the end of June.
Delivery is now due by April 2009, although Athena said May (to be on the safe side). (We found Athena very helpful when we were out there - we've even chosen our tiles!)

Sorry Janda, I'm going to be very negative.
I am fed up with ringing Paschali and getting the usual codswollop. On last contact I was told that heavy machinery was on its way - as I have pointed out in my last post, this must be special invisible heavy machinery. I am a very busy man and have no further inclination to waste my time on lies.
My main aim now is to sit tight, see what develops and wait for the clauses in my contract to kick in - I assume its a fight then and I am prepared for that.

Didnt get time to go to Paschali as it was Easter and everything closes down. I think most developments are behind especially now because of the water situation. I dont think we will get delivery in Feb next year. Do you have an update from the builders when completion might be.

When I last spoke to Athena she said that building equipment was already there - it must be invisible machinery!! Nothing surprises me anymore with Paschali.
Speaking to my solicitor, I am informed that I have to wait until the penalty clause canbe applied within my contract next year. At least I now have truly independent advice and not the previous MRI recommended solicitor - so can sleep better. Luckily, I can also afford a long protracted legal battle and pay my mortgage if the proverbial muck hits the fan, so take solace in that.

just got back from Cyprus today. Went to the site and yes, no work started although planks of wood are there for the start of construction.
As it has just been Easter and now May day bank holiday nothing will get started until next week.
Returning in June so will keep you up to date with development.

We were told delivery was scheduled for February 2009 so from what you've been told it should be ready March 2009, although that sounds a tad optimistic!.
We are out in Cyprus in a few weeks time so will take some photos and post to this site.
