Résumé of the discussions during the A.G.M of “Residencial Brisas del Termes” on the 16th of June 2007
 
Pool maintenance
 
The ordinary maintenance of the pool is more expensive during the summertime than during the wintertime. From May till September the Community has to pay € 230.- per month and from October till April € 150.- per month. After it was discovered that the pool was leaking the maintenance was stopped in order to avoid having to pay for cleaning that was not happening. It took a while but the pool is repaired now and it looks like it is not leaking anymore.
 
Insurance
 
The Community is now insured. The insurance covers the Community of Owners for the apartments and duplexes as well as the Community of Owner for the garages. The later pays the first for its’ share in the premium. The reason for setting up the insurance in this way was the fact that is a lot cheaper than separate insurances for each community.
 
 
Key-box
 
The keys to the communal area are stored in the key-box. The President has one key of this box and the Administrator has the other one. If you need it to have some job done in your property and a key to something within the communal area is needed to do it, you can ask the President for the key. Please, return it as soon as the workmen have finished.
 
Budget
 
The budget has not been presented to the owners before the meeting. Therefore they could not discuss it in preparation of this A.G.M. The members requested the Administrator to present the budget to the owners always before an A.G.M. The Administrator said that she did not present a budget because the budget she is proposing is the same as last year. She is of the opinion that the budget should be kept the same because during the last financial year the Community did not pay for pool maintenance for the whole year and neither for electricity nor water. The pool was broken most of last year and therefore the Community did not have to pay for the maintenance. The builder has not yet been able to transfer the electricity and water from builder’s supply to mains electricity and water. It is to be expected that this will be done this year and the Community will have to take into account that it will have to pay for its’ water and electricity bills. If a surplus is left at the end of next year, this will be added to the reserve and available capital of the Community.
 
The Community decided to nice up the communal area by purchasing 3 stone benched and 2 plant pots. The last ones will be purchased by Mary. She can present a quote for the purchase to the Administrator. Furthermore the Community will also purchase rails for the staircases in order to avoid people from falling on them. The staircases are especially dangerous when it is raining and they are wet.
 

Committee
 
José continues to be the president for an other year. It is obligatory for a Community to have an owner to take on the function of president of the Community. Next to the president the Community can elect some other owner to be vice-president. During the meeting 4 other owners were elected as vice-presidents.
 
Problems with the Community
 
If an owner encounters a problem concerning the communal area or affecting the Community, he or she is requested to report this to the President, so a solution can be found.
 
Intercom-system
 
The builder has not put in an intercom-system and as a consequence of this omission the owners of the duplex have no means of being alerted that they have a visitor. The Administrator will check with the Town Hall if the builder did put an intercom-system in the project for the construction presented to the Town Hall in order to acquire a building permit. If not, she will check whether Spanish law obligates a builder to put in an intercom-system. She will report her findings to the President.
 
Responsibility for maintaining the plants
 
In principle Begonia has accepted the responsibility to water the plants.
 
Disabled people
 
At this moment there is no obligation to provide special access for disabled people. The law will soon change in this respect but this will not affect this building since it has been build before this change went into effect.
 
Work to be finished by the builder Solimar
 
Solimar is obligated to finish the garage area, the staircases and to repair the shower close to the pool. Furthermore they should fill up the area where the Jacuzzi used to be and make it nice. They will be given a certain period to do the jobs. If they refuse to do so, the Administrator will start up legal actions against the builder.
 
There are some minor technical problems within the Community. An electrical pluck that has a loose cover and a pool light that is not working. Patrick will look into this problems and if necessary inform the Administrator to contact the builder to do its’ job and repair it.
 
Mains water and electricity and habitation certificates
 
The Town Hall has not issued the habitation certificates and therefore it is not possible to contract mains water and electricity. It was mentioned that the certificate from the electrician to sign off the work for wiring in the communal area was missing. The Administrator will look into this problem and try to find out what is the real reason for not issued the habitation certificates. 
 
Rubbish falling into the Community area from the construction site next door
 
Next to the Community an other constructor is building an other building. These construction works cause a lot of rubbish that falls into the communal area. The workers have already several times been asked to clear the rubbish and prevent it from falling into the communal area. They have refused to cooperate. The Administrator will contact the builder and ask him act in such a way as to prevent this problem since it might cause injuries to the owners.
 
Garage
 
It has been noticed by several owners that outsiders where present or leaving the garage-area with a key to the garage. So some members are wondering whether Solimar has rented out parking spots within the garage to people from outside. The Administrator said that only the owners within the Community have access to the garage and no outsiders. She will look into this situation and advises the owners to ask outsiders to leave.
 
 
Cleaning of the communal area
 
Begonia cleans the communal area every week on Thursday or Friday. The owners are requested no to put any objects or laundry in the communal area on the days that Begonia cleans it.
 
Dogs
 
Some tenants have left their dogs in the communal area and unfortunately some dogs left their droppings behind. Therefore it has been decided that dogs are prohibited to be in the communal area.
 
Community rules and tenants
 
Every owner that rents out an apartment has the obligation to inform his or her tenants about the Community rules and regulations. Tenants have to maintain these rules in the same way as the owners. The Administrator will put this remark into the minutes.
